Automotive and auto parts: the tax rule changes at every link in the chain and SAP has to keep up invoice by invoice

The same assembly passes through the supplier, the system integrator, the carmaker and the dealer. At each link, the ST regime, the PIS and Cofins treatment, the origin of imported inputs and the credit the plant can take all change. The tax director only sees the total at the close.

This page covers what DFSpro read in official sources on ST for auto parts, the automotive regime, drawback, Block K and the Reform, plus the SAP setup points that fail most often. ST (tax substitution) means one party withholds ICMS for later sellers. ICMS is Brazil's state value-added tax. PIS and Cofins are federal taxes on revenue. The tax decision is the client's. Our role is to design the configuration, adjust it and prove that it works.

What weighs on automotive and auto parts, tax by tax

The direct answer

In the automotive chain, there is not one tax: a part may have ST in one state (UF) and not in another, the imported input may be under drawback and the sale may be single-stage, all in the same week.

To start the conversation: does your ST table by part already separate, for each destination state, what is on the Protocol 41/08 list and the CEST of each item?

The short answer: if it separates them, ST is withheld for the right destination. If not, the starting point is a matrix of part by state, tested on one month of invoices.

ST on auto parts: what Protocol 41/08 and Agreement 142/18 say, in the text we read

ICMS Protocol 41/08 covers ST on interstate operations with auto parts. Agreement 142/18 has the list of parts with NCM and CEST. NCM is the Mercosur product code, and CEST is the code that identifies goods under ST.

Who withholds and when it is paid

The sending establishment withholds and pays the ICMS on the following operations. The tax withheld is the difference between the amount calculated on the ST base and the one on the own operation, and it goes to the destination state by the 9th of the month after shipment (clauses 1, 3 and 4).

Which parts are covered

Those in Annex II of Agreement 142/18, which in the text we read has 132 distinct CEST codes (the CONFAZ page shows 140 lines because it repeats items with earlier wording, and 01.110.00 appears as revoked by ICMS Agr. 165/19), including sub-item codes and line 01.999.00 (other parts not listed). The protocol applies to products of specifically automotive use and leaves out six CEST codes: 01.019.00, 01.062.01, 01.112.00, 01.127.00, 01.128.00 and 01.999.00.

Where it applies

In the current text of the CONFAZ page, the destination states are Acre, Alagoas, Amazonas, Amapá, Bahia, Maranhão, Mato Grosso, Minas Gerais, Pará, Paraíba, Piauí, Paraná, Rio de Janeiro, Roraima and the Federal District. São Paulo leaves with Protocol 93/26, and the page itself shows conflicting date marks for that effect.

Where it does not apply

Shipment to an industrial establishment (clause 1, § 2, I) and shipment to another establishment of the same owner that is not a retailer, unless the destination state provides otherwise (§ 2, II; the exception is only in item II). A parts wholesaler controlled by a motor vehicle maker, which operates only with the dealer network under a loyalty contract, is treated as the carmaker (clause 1, § 6).

Calculation base and MVA

List price

The base is the maximum retail price set by the authority or, if there is none, the price suggested to the public by the maker or importer, plus freight when not included (clause 2).

No list price

The base is the sender's price plus freight, insurance, taxes and charges, increased by the adjusted MVA (the markup used to estimate the later resale price): [(1 + original ST MVA) x (1 - interstate rate) / (1 - internal rate)] - 1.

Original ST MVA

Under the wording marked as in force on the page, 36.56% on exits from a carmaker to meet a purchase loyalty index and in exclusive distribution under a loyalty contract, and 71.78% in all other cases.

Other sector agreements

Tires have their own annex in Agreement 142/18 (Annex XVI) and motor vehicles another (Annex XXIV). Direct billing from the carmaker to the consumer follows ICMS Agreement 51/00, with two extra copies of the invoice and a statement of the bases.

Official source, read on 19/10/2026

ICMS Agreement 142/18, clause 5: the ST rules for motor vehicles with direct billing to the consumer, among other segments, are covered by specific agreements, and the rules of 142/18 apply to them as a supplement. Annex I of the same agreement separates auto parts (segment 01), tires (16) and motor vehicles (25).

DFSpro's judgment

A company that supplies the carmaker and the aftermarket at the same time makes two operations of a different nature with the same part: one to the industrial establishment, outside the protocol, and one to the wholesaler, inside it. The rule by recipient and by state must be master data, not a decision for whoever keys in the invoice.

Regimes and incentives

Mover Program, automotive regime and incentives: what applies and until when

Four laws define federal automotive policy that the tax team needs to know. The deadlines below were read in the official texts.

Mover Program, 2024

Law 14,902 sets mandatory requirements for new vehicles, an incentive regime for research and development, a regime for auto parts not produced in Brazil and the FNDIT. The financial R&D credit equals 50% of the spending, capped at 5% of gross revenue, and counts as CSLL credit (arts. 16 and 17).

Rota 2030, partly repealed

Law 13,755/2018 created Rota 2030 and the regime for auto parts not produced in Brazil. Law 14,902 repealed some of its provisions. Which articles remain in force by regulatory act: not checked.

Regional automotive regime

Art. 11-C of Law 9,440 and arts. 1 to 4 of Law 9,826 give presumed IPI credit to projects in the Sudam, Sudene and Center-West areas (federal regional development agencies). The text of Law 9,826 limits use to exits up to 31/12/2025. LC 214 extended the IPI benefits to 31/12/2026 (art. 316).

Presumed CBS credit

From 2027 to 2032, projects approved under these regimes get a presumed CBS credit. Under Law 9,440, they are 11.60%, 10% and 8.70% on domestic sales by time band, reduced 20% a year from 2029 to 2032 (LC 214, arts. 309 to 313).

Official source, read on 19/10/2026

LC 214, art. 309: the presumed CBS credit encourages only the production of vehicles with an electric motor able to drive the vehicle on electric power alone, and applies to projects approved up to 31/12/2024 of companies already approved on 20/12/2023 and to new projects approved up to 31/12/2025. Art. 313: the credit cannot be transferred to another establishment or refunded, and only offsets debits of the approved establishment.

DFSpro's judgment

For a company with one incentive plant and others without incentives, the border between establishments becomes tax and accounting. Balance, debit and allocation must be separated by plant from the setup.

Supplier chain

High volume of NF-e: where each link in the chain leaves data that the next one uses

A company that supplies at assembly-line pace issues many invoices a day. A master data error does not show up in one invoice, but in the month's total.

One invoice per link

The NF-e model 55 was created by SINIEF Adjustment 07/05 for IPI and ICMS taxpayers. The supplier, the system integrator, the carmaker and the distributor each issue their own, and each one's credit depends on data from the previous link.

CEST and ST on the invoice

Whoever withholds states the item's CEST and the ST value withheld. A mismatch between the CEST of the material and the one in the agreement leads to too little withheld, too much, or rejection of the invoice.

FCI of the input

The FCI number goes with the invoice for a product with import content and decides whether the interstate operation goes out at 4%. An imported input changed without updating the FCI changes the rate for the whole line.

Direct billing

On a vehicle sale billed by the carmaker to the consumer, with delivery by the dealer, the agreement requires two extra copies of the invoice and a detailed statement of the bases of the two operations.

DFSpro's judgment

At high volume, sampling invoices is not enough. The proof that matters is a reconciliation by access key, between what the master data says and what went out on the invoice, with differences listed by state and by CEST.

What breaks in SAP

Eight SAP points that often differ from the rule in auto parts

This is DFSpro's judgment, not a measurement: these are the points where we most often see the configuration drift from the rule. Each one comes with the symptom the tax team notices and the proof that ends the doubt.

State and CEST list of Protocol 41/08

Symptom: ST withheld for a state that left the list, or no withholding for a state that joined, and rejection by the destination. Proof: matrix of state and CEST by invoice date, tested on a sample of invoices from each state.

Industrial destination confused with resale

Symptom: ST withheld on a part shipped to the carmaker or the system integrator, which the protocol excludes. Proof: report of ST by type of recipient, with the exception rule of § 2 of clause 1.

ST base and adjusted MVA

Symptom: ST different from the recalculation, because the price charged was used when a suggested price existed, or MVA with no adjustment. Proof: recalculation of the formula on a sample of invoices, by interstate and internal rate.

FCI and the 4% rate

Symptom: operation with an imported input at the general rate when the content is above 40%, or the opposite, with an old FCI version. Proof: comparison of the current FCI of each product with the rate shown on the invoice.

Drawback not closing

Symptom: grant act with an imported input balance that does not match the consumption and exports proven. Proof: reconciliation between import, stock write-off, production order and export invoice.

Concentrated PIS and Cofins

Symptom: sale of an auto part at the reseller rate to a carmaker, or the opposite, and 2026 stock with no treatment for the turn of the year. Proof: classification by customer and by product against art. 3 of Law 10,485.

Incentive plant and regular plant

Symptom: presumed credit calculated by plant that mixes sales without the full CBS requirement, or balance used outside the approved establishment. Proof: calculation record by plant with its own debits and the allocation.

Block K and component consumption

Symptom: K230 and K235 that do not match the consumption recorded on the orders, especially in supply at line pace. Proof: monthly reconciliation between production order, component entry invoice and EFD record.

Where DFSpro solves it

What DFSpro solves in the auto partschain, in six areas

Carmakers, system integrators and parts distributors face the same pressure: high invoice volume, regimes by plant and a switch in 2027 that already starts with the inventory. Each area turns a client decision into a tested rule, with no improvising in the tax calculation.

Buyer

Customer as tax data

Industry, resale and retail change the ST, the concentrated PIS and Cofins and the buyer's credit. DFSpro classifies the customer in the master data, with validity by state, and tests each type of buyer. The error stops being born on the invoice.

Stock

Parts ready for 2027

Anyone holding parts bought with ST or single-stage taxation needs to know, in the 31/12/2026 inventory, what came in that way. DFSpro lists the stock by item and origin and proves the classification. Taking the credit is the client's decision.

Plants

Incentive plant kept apart from the regular one

Presumed credit and presumed CBS apply by establishment and project, and art. 313 limits transfer and refund. DFSpro separates the plants in the master data and in the tax calculation and tests each behavior.

Selective

Vehicle master data ready

The Selective Tax on vehicles will be graded by attributes such as power, efficiency and emissions. DFSpro designs the product fields now, so the data exists when the ordinary law sets the rates.

Drawback

A balance that closes

Drawback usually differs in the balance per grant act against consumption per production order. DFSpro designs that link and proves the close, with no rush at the end of the term.

AMS Fiscal

Protocol states under control

The list of ST states changes, and a delay in one of them can suspend the agreement. In AMS Fiscal, states, registrations and status go into the tax health report, with every change recorded and approved.

Reform

The move to IBS, CBS and the Selective Tax in the automotive chain

The direct answer

For auto parts, the Reform first changes the concentrated PIS and Cofins, which end in 2027, and only later the ICMS, which falls from 2029 to 2032.

2026, a transition year

The test rates are IBS 0.1% and CBS 0.9%, but a taxpayer that is up to date with its ancillary obligations does not have to pay (LC 214, art. 348, § 1); anyone who pays offsets it or gets a refund within 60 days, and Simples taxpayers are left out (item III, c). Those who are exempt must still pay Cofins in full, the importer's contribution (art. 195, IV, of the Constitution) and PIS (art. 239), under § 2. The concentrated PIS and Cofins on auto parts still apply in 2026.

2027, end of single-stage taxation and stock credit

On 01/01/2027, LC 214 removes arts. 1, 2, 3, 5 and 6 from Law 10,485 (art. 542, XVI) and creates a presumed CBS credit on stock that had single-stage taxation (art. 381). IPI goes to zero, except in the Manaus Free Trade Zone (ZFM). The start of the Selective Tax on vehicles: not checked.

2029 to 2032, ICMS falling and benefits with it

Between 2029 and 2032, ICMS is worth 9/10, 8/10, 7/10 and 6/10 of the set rate, and state benefits fall in the same proportion (ADCT, art. 128). The presumed CBS credit of the automotive regime falls by 20% of the initial percentage each year.

Drawback and exports under IBS and CBS

LC 214 suspends IBS and CBS on imports under an inward processing regime and covers drawback in the suspension form (art. 90, § 3), and removes the exemption and refund forms of drawback (art. 91). If the good is not used in the exported product, IBS and CBS become due.

Selective Tax on vehicles

Art. 409 includes vehicles among the goods subject to the Selective Tax. It applies only once and bars use of credit from an earlier stage or creating credit for the next one (art. 410). The taxable event is the first supply, the addition to the fixed assets of the maker, the non-onerous transfer and the consumption of the good by its maker (art. 412). The taxpayer is the maker or the importer (art. 424). Until 31/12/2032, ICMS and ISS stay out of the base (art. 417, § 4). The rate is zero for a vehicle sold to a buyer under a differentiated regime recognized by the RFB, the Brazilian Federal Revenue Service (art. 420). Numeric rates: not checked.

Credit on parts stock (art. 381)

A taxpayer in the regular CBS regime can take a presumed credit on the stock of physical goods on 01/01/2027, including goods bought with ST or the single-stage taxation of Law 10,485 (item II, letter b). It applies only to new goods and does not reach fixed assets (§ 1). The credit is 9.25% on stock bought in Brazil and, for imports, equal to the PIS and Cofins-Import paid (§ 3). It must be taken by the last day of June 2027, used in 12 monthly installments and offsets only CBS, with no refund (§ 4). The right ends after 5 years (art. 383). The act of the Executive on checking the stock (§ 2): not checked.

Manaus Free Trade Zone

LC 214 leaves passenger cars outside the favored regime of the Free Trade Zone (art. 441, d). Under Decree-Law 288/1967, the IPI exemption for goods made in Manaus does not apply to those in art. 3, § 1, including passenger cars, but art. 9, § 2 makes an exception for quadricycles, tricycles and their parts. How this applies to the plant is the client's tax analysis, not our decision.

Official source, read on 22/10/2026

Arts. 381, 383, 409 to 424, 441 and 544 of LC 214 and arts. 3 and 9 of Decree-Law 288/1967 were read again on Planalto. Art. 544 does not name arts. 409 to 433 among those that take effect in 2027 or 2029, so the start date of the Selective Tax stays not checked.

Official source, read on 19/10/2026

LC 214, Annex XVII, Vehicles section: 87.03 and positions 8704.21, 8704.31, 8704.41.00, 8704.51.00, 8704.60.00 and 8704.90.00, except trucks, with an exception for operational vehicles of the Armed Forces and public security. Art. 419 requires the rate to be graded by power, efficiency, recyclability, carbon footprint, manufacturing steps in Brazil and category, under an ordinary law. Annex XVII does not list auto parts.

DFSpro's judgment

For an auto parts supplier, the direct impact of the Reform is the end of single-stage taxation, the stock credit and the coexistence of ICMS and IBS during the transition. The Selective Tax weighs on the price of the vehicle, and so changes the carmaker's order volume, not the invoice for the part.

Sector situations

Production lines in three shifts, tooling at the supplier's plant, parts on consignment at the customer's line, recalls by batch or chassis. In the automotive sector, operations create tax situations that stay under control only with design and proof in SAP.

16ST

ICMS-ST on auto parts: Annex II, CEST on every invoice and the right MVA in the base withheld

What weighs: Every auto part item needs a CEST on the invoice, even without ST, and a wrong MVA becomes a difference flagged by data cross-checks.

What DFSpro changes: CEST and MVA master data by item and by destination state, with the non-application rule shown on the invoice.

See the situation, the legal basis and the proof

The situation

Auto parts producers and distributors sell to many states, each with its own MVA, and the tax authority cross-checks NF-e, GIA and EFD.

Proof delivered

Matrix of models with attributes, expected simulated rate and calculation obtained.

The tax position in each situation is the client's decision. DFSpro designs the behavior in SAP, configures it and proves it with scenarios, so the client's decision runs the same way on every document. Where to start: the SAP Tax Diagnostic.

How DFSpro comes in

Diagnostic, AMS Fiscal and GUEPARDO Tax in the sector

Tax diagnostic

Maps the setup of ICMS, ST, FCI, drawback, PIS and Cofins and the credit in use at each plant and each distribution center, compares it with the rule read and ranks by risk: critical, high, medium or monitor.

Project and AMS Fiscal

Designs and configures in SAP the rule the client chose and delivers proof that it works. In AMS Fiscal, tracks changes in protocols, agreements and annexes through the year, such as the list of ST states for auto parts.

GUEPARDO Tax

NTT DATA owns GUEPARDO Tax. DFSpro deploys it, handles its governance and sells the license as an Authorized Channel, and the rule the client chose is configured and tested inside it.

The limit of our role

The tax decision is the client's: for example, which state benefit to use, how to treat the credit balance or which position to take in each state. DFSpro starts where the decision ends: it designs the configuration, applies it in SAP and documents the result with proof.

Frequently asked questions

Questions from the tax director of auto parts on ST, drawback and credit

01Does an auto part shipped to another state always have ST?+

No. Protocol 41/08 applies only to parts in Annex II of Agreement 142/18, for automotive use, when the destination is a signatory state and outside the six excluded CEST codes. Shipment to an industrial establishment is left out. So is shipment to another establishment of the same owner that is not a retailer, unless the destination state has a different rule.

02Does a part going to the carmaker's line pay ST?+

Under the text of the protocol, ST does not apply to shipments to an industrial establishment. The same part sold to a wholesaler or a retailer, in a signatory state, falls under the rule. That is why classifying the recipient is tax data, not a master data detail.

03How is the ST base for auto parts calculated?+

It starts from the maximum retail price or, if there is none, the price suggested by the maker or importer, plus freight. Without those values, it uses the sender's price with charges and the adjusted MVA. The original MVA read is 36.56% in loyalty cases and 71.78% in the others.

04Until what day do I pay ST on auto parts?+

The protocol sets the 9th of the month after the goods leave, in favor of the destination state (clause 4). The payment slip and the local rules of each state were not read for this page.

05Does a transfer between my plant and my distribution center pay ICMS?+

Since 01/01/2024, no. LC 204 barred ICMS on a shipment to an establishment of the same owner and kept the credit. The same law allows, as an option, treating the transfer as a taxed operation. The choice is the client's.

06When is the interstate rate 4%?+

When the good is imported and was not processed, or when the product's import content is above 40%. There are exceptions, such as a good with no domestic equivalent and the basic production process. The FCI number goes on the invoice, under Agreement 38/13 (clause 5).

07Does the presumed IPI credit of the automotive regime end?+

Art. 11-C of Law 9,440 refers to sales up to 31/12/2025, and LC 214 extended the IPI benefits to 31/12/2026. After that, approved projects move to the presumed CBS credit, with a term up to 2032 and falling percentages. Art. 542, VII, of LC 214 repeals arts. 11-A to 11-C of Law 9,440 from 01/01/2027. Law 9,826 does not appear in the list in art. 542 in the text read.

08Do the concentrated PIS and Cofins on auto parts continue?+

Until 31/12/2026, art. 3 of Law 10,485 continues: 1.65% and 7.6% on sales to a carmaker or industrial company, 2.3% and 10.8% on sales to a reseller or consumer. LC 214 repeals these articles from 01/01/2027 and provides a presumed CBS credit on stock, under the conditions of art. 381. The credit must be taken by the last day of June 2027, in 12 monthly installments, and offsets only CBS (art. 381, § 4).

09Does the Selective Tax reach auto parts?+

In the text read, Annex XVII lists vehicles (87.03 and part of position 8704, except trucks), aircraft, vessels, tobacco products, drinks and minerals. Auto parts are not listed. The rates depend on an ordinary law, and that law was not read. The tax applies only once, with no use of credit from an earlier stage (art. 410), and the taxpayer is the maker or the importer (art. 424).

10Does drawback continue after the Reform?+

LC 214 covers the suspension form of drawback (art. 90, § 3), but says the exemption and refund forms of drawback do not apply to IBS and CBS (arts. 90 and 91). If the good stops being used in the exported product, the tax becomes due.

11Until when does my state ICMS incentive apply?+

It depends on the granting act and on how it fits in Agreement 190/17, which sets maximum periods of use, such as 31/12/2032 for benefits that promote industrial activity. The act of each state was not read. Keeping or swapping the benefit is the client's choice.

12Is Block K mandatory for my parts plant?+

For an industrial establishment of a company with revenue of BRL 300 million or more, full bookkeeping began on 01/01/2019 in CNAE groups 291, 292 and 293. For other cases, the classification stays not checked. Confirm your CNAE before assuming the obligation. In the Practical Guide, K200 reports stock, K230 and K235 the production and inputs by order, K250 and K255 the processing done by third parties (K255 is mandatory when K250 exists) and K260 the rework in the same establishment. Check the current version of the Guide on the SPED portal.

13Does a part made in the Manaus Free Trade Zone have IPI?+

Decree-Law 288/1967 exempts from IPI the goods made in the Manaus Free Trade Zone (art. 9). The exemption does not apply to the goods in art. 3, § 1, including passenger cars, but § 2 of art. 9 makes an exception for quadricycles, tricycles and their parts. LC 214 also leaves passenger cars outside the favored regime of the Free Trade Zone (art. 441, d). How this applies to your plant is the client's analysis.

14What should I bring to the first conversation?+

The list of plants and distribution centers by state, the two or three destinations with the highest volume, the latest ST or credit difference, and the SAP version. From that list come the first scope and the order of the work.

Next steps

Bring the plants, the destinations and the ST or credit difference that worry you most

Tell us in which states the company produces, who it sells to and which inputs it imports. The scope is set in that conversation, and the price comes after it.

Before the conversation, it helps to read about SAP tax diagnostic and CBS and IBS tax reform.
