ICMS and credit3 rules

The general rule of the tax and the rule on credit, reversal and fixed assets.

In force

Complementary Law 87/1996 (Kandir Law)

What it covers
General ICMS rule: taxpayer, taxable event, place of the operation, tax base and credit, and it sets the tax substitution regime in arts. 6 to 10.
Status
In force. The tax base starts to include the Selective Tax from 01/01/2027 (art. 13, § 1, III, added by LC 227/2026).
What to watch in SAP

Rate, base and credit rule by state need dated validity in the master data and in the calculation. The interpretation belongs to the client.

In force

LC 87/1996, arts. 19 to 21: credit and reversal

What it covers
Non-cumulative ICMS (art. 19). Art. 20 gives credit on the entry of goods or services, including fixed assets, but not on an entry that is exempt, not taxed or unrelated to the activity (§ 1). Credit on goods for use or consumption applies only to entries from 01/01/2033 (art. 33, I). Art. 21 lists the cases of reversal.
Status
In force.
What to watch in SAP

The credit and reversal rule lives in the setup by CFOP and entry type. Check that each case in art. 21 has a trigger in the process.

ICMS calculation in SAP

In force

LC 87/1996, art. 20, § 5: fixed asset credit (CIAP)

What it covers
Fixed asset credit enters at 1/48 per month, times the share of taxed outbound sales (exports count as taxed). If the asset is sold before 4 years, the remaining part is no longer credited. In the 48th month, the balance is cancelled.
Status
In force, as worded by LC 102/2000 and, in item III, by LC 120/2005.
What to watch in SAP

Each asset needs an entry date and a credit amount, and the share changes every month. Writing off the asset stops the future installments.

Agreements and incentives12 rules

Who can grant an ICMS incentive, how the old incentives were validated, and examples of agreements and of states, with the official source.

The general rule

In force

Complementary Law 24/1975

What it covers
An ICMS exemption is valid only if it is granted or revoked by an agreement signed and ratified by the states and the Federal District (DF). This also covers a base reduction, a presumed credit and a tax refund (art. 1, sole paragraph). Granting requires a unanimous decision (art. 2, § 2).
Status
In force. Several articles refer to LC 214/2025 for when they take effect.
What to watch in SAP

Non-compliance makes the act void and the credit of the buyer of the goods ineffective (art. 8, I). The incentive record must keep the act that supports it.

State tax incentives in SAP

In force, with deadline

Complementary Law 160/2017

What it covers
Authorizes an agreement to forgive credits and to reinstate ICMS incentives granted without an agreement. It requires publication, registration and filing at Confaz (art. 3) and sets maximum use periods by category (art. 3, § 2).
Status
In force, changed by LC 170/2019 and 186/2021. Art. 128, § 2, of the ADCT (EC 132) orders the incentives of art. 3 to be reduced as set in art. 128 itself and rules out the reduction of § 2-A of LC 160.
What to watch in SAP

The end date depends on how the incentive is classified, which is for the state. The system needs an end date per incentive. The two deadlines, side by side, are in State incentives in SAP.

Incentives in SAP and EC 132

In force, with deadline

ICMS Agreement 190/2017

What it covers
Forgives and grants amnesty on credits from incentives created by law published up to 08/08/2017 (cl. 8), allows them to be reinstated and creates the National Tax Transparency Portal (cl. 7). It lists 17 kinds of incentive (cl. 1, § 4).
Status
In force, with 19 changes, the last being Agreement 180/23. National ratification on 26/12/2017. Use period to 31/12/2032 in categories I to IV (cl. 10, as worded by Agr. 68/22).
What to watch in SAP

Cl. 10, § 5, brings a 20% yearly reduction from 01/01/2029 for commercial, raw agricultural and port activities. Keep the source act, validity and end date.

State tax incentives in SAP

In force, with deadline

ICMS Agreement 68/2022

What it covers
Gave new wording to items I to IV of the tenth clause of Agreement 190/17 and set 31/12/2032 as the final use date in the four categories: agricultural and industrial development and infrastructure (including temples and charities), port and airport activity of international trade, commercial activities with the actual sender, and interstate operations with raw agricultural and plant extraction products.
Status
In force, with effect from 20/05/2022.
What to watch in SAP

The classification is made by the granting state (cl. 11), and another state can challenge it within 180 days. The record needs the category and the end date of each incentive.

Examples of agreements

In force, with deadline

ICMS Agreement 52/1991 (machinery and implements)

What it covers
Reduces the ICMS tax base on industrial machinery and equipment (Annex I) and on agricultural machinery and implements (Annex II). In Annex I the burden is 5.14% on outbound sales from the South and Southeast (except ES) to the other regions and ES, and 8.80% on other interstate sales and on domestic ones. In Annex II, 4.1% and 7.0% on interstate sales and 5.60% on domestic ones.
Status
In force through extensions, the last to 31/12/2026 by Agreement 10/26.
What to watch in SAP

Cl. 4 waives the reversal of the entry credit, and cl. 5 orders the destination state to reduce the DIFAL base to the same domestic burden. Reversal by state is a rule to set up.

Agreement 52/91 and reversal, on the blog

In force, with deadline

ICMS Agreement 100/1997 (agricultural inputs)

What it covers
Reduces the ICMS tax base by 60% on interstate sales of agricultural inputs, such as pesticides, vaccines, serums, farm and livestock medicines and feed registered with Mapa (cl. 1), and by 30% on items such as soy and canola meal and cake for feed (cl. 2). It bars the incentive when the product has a different use.
Status
In force, extended to 31/12/2027 by Agreement 79/25. Item II of the first clause (acids, natural phosphate and sulfur) was repealed from 01/01/2022 (Agr. 26/21).
What to watch in SAP

Cl. 4 gives a presumed credit to the establishment that receives the product with a reduced base when its own state does not grant an equal reduction. Cl. 3-A, added by Agreement 26/21, sets a 4% burden for fertilizers and manure and keeps it for acids and sulfur, whose item II of cl. 1 was repealed; cl. 3-B conditions the reduction on imports. The incentive applies by NCM and by use.

In force, with deadline

ICMS Agreement 10/2026 (extension of 52/91)

What it covers
Extends Agreement 52/91 to 31/12/2026 (cl. 1) and rewrites § 2 of the fourth clause: Paraná, Rio Grande do Sul, Santa Catarina and São Paulo may choose not to apply the waiver of entry credit reversal (cl. 2).
Status
Signed on 27/01/2026, published in the DOU of 29/01/2026 and ratified on 19/02/2026 (Declaratory Act 4/26), with effect from 01/05/2026 (cl. 3).
What to watch in SAP

In these four states the reversal waiver is optional. Anyone who ships or receives machinery from them needs a reversal rule by state, with a cut-off on 01/05/2026.

In force, with deadline

ICMS Agreement 79/2025 (extension of 100/97)

What it covers
Extends Agreement 100/97 to 31/12/2027 (cl. 1), rewrites the seventh clause so that it stays in force until that date (cl. 2) and repeals the fourth clause of Agreement 26/21 (cl. 3).
Status
Signed on 04/07/2025 at the 197th meeting, published in the DOU of 08/07/2025 and ratified on 25/07/2025 (Declaratory Act 16/25).
What to watch in SAP

The incentive of 100/97 has an end date of 31/12/2027. The record needs it by NCM, and the reduction rule must stop applying at the turn of the year.

Examples of state law

In force, with deadline

Santa Catarina: Decree 105/2007 (Pró-Emprego)

What it covers
Regulates the differentiated ICMS tax treatment for projects to set up, expand, restart or modernize in Santa Catarina (art. 1), with deferral and extension depending on the classification.
Status
In force as a program reinstated by Law 17.763/2019 (art. 1, I), per the SEF/SC note in the decree itself. It regulates Law 13.992/2007.
What to watch in SAP

The incentive is by resolution and type of treatment. Keep the resolution, scope and period by establishment. The decree is not the individual resolution.

In force

Minas Gerais: RICMS/2023, Annex IV (presumed credit)

What it covers
Lists the presumed credit cases of art. 45 of RICMS/2023, with columns for case, presumed credit, effectiveness and grounds.
Status
In force. In items 1, 2 and 3 of Part 1, effectiveness runs to 31/12/2032, based on Agreement 190/17 and Decree 47.394/2018.
What to watch in SAP

An example of an incentive with a deadline and a basis in its own text: the record needs both fields.

In force

Bahia: Law 7.980/2001 (Desenvolve)

What it covers
Authorizes an extension of up to 90% of the monthly normal ICMS balance due, for up to 72 months, and deferral, for new industry, expansion, restart and modernization (arts. 2 and 3). Use does not exceed 12 years (art. 6).
Status
In force, with effect from 01/01/2002 (art. 11). Among the changes, Law 13.816/2017 added art. 9-A.
What to watch in SAP

It is a financial incentive: the calculation separates the incentivized ICMS, booked separately, from the normal one. Late payment of the normal part makes the incentivized part of the month lost (art. 9-A).

In force, with deadline

Goiás: Law 13.591/2000 (Produzir)

What it covers
Creates the Goiás Industrial Development Program (Produzir) and the Industrial Activity Development Fund (Funproduzir), with financing for projects to set up, expand and modernize (arts. 1, 3 and 4). The state's contribution to the fund does not exceed 73% of its share of the tax paid by the beneficiary (art. 17, § 2).
Status
Consolidated text with changes up to Law 23.245/2025. Law 20.997/2021 bars new grants since 03/05/2021. Since 01/01/2021 (Law 20.978/2021), art. 19 uses the cut-off date of art. 3, § 2, of LC 160.
What to watch in SAP

It is a financial incentive: the record separates the tax due from the financed amount. The financed amount depends on a contribution to the Protege Goiás fund, at the rates of Law 18.360/2013 (up to 15% of the incentive, Law 20.367/2018). The period and installment stay in the contract.

DIFAL and revenue sharing4 rules

The rate difference on sales to a non-taxpayer end consumer in another state and the revenue sharing that Amendment 87 set until 2019.

In force

Complementary Law 190/2022 (DIFAL)

What it covers
On an interstate sale to a non-taxpayer end consumer, the sender pays the difference between the destination's domestic rate and the interstate rate (art. 4, § 2, II, of LC 87). The base is single (art. 13, X).
Status
In force since 05/01/2022. The law refers its effects to the annual-rule principle of art. 150, III, "c", of the Constitution and sets no date of its own.
What to watch in SAP

Credit from earlier stages offsets only the origin's debit (art. 20-A). Under art. 24-A, § 4, the effects start on the 1st business day of the 3rd month after the states' portal becomes available.

Tax calculation in SAP

In force

ICMS Agreement 236/2021

What it covers
Sets the DIFAL procedure: destination domestic rate on the total, interstate rate for the origin, difference to the destination (cl. 2). The poverty fund surcharge goes on a separate payment slip, at the destination's discretion. Payment by GNRE on exit (cl. 5).
Status
In force, published in the DOU of 06/01/2022.
What to watch in SAP

Anyone registered in the destination pays by the 15th day of the next month (cl. 6, § 2). With no exit date on the document, the issue date applies (cl. 5, § 4).

Tax setup in SAP

In force

ICMS Agreement 153/2015

What it covers
Exemption and base reduction authorized by agreement, in force and in line with LC 160, enter the DIFAL calculation on a sale to a non-taxpayer end consumer, when applied at the origin or at the destination.
Status
In force. Changed by Agreements 191/17 and 51/23. The wording of the main provision has effect from 26/12/2017.
What to watch in SAP

The calculation must know, by item and state, whether there is an agreement incentive at the origin or destination and whether it reduces the DIFAL base.

In force

Constitutional Amendment 87/2015 (DIFAL and revenue sharing)

What it covers
Changed art. 155, § 2, VII and VIII: on a sale to an end consumer in another state the interstate rate applies, and the recipient's state keeps the difference up to the domestic rate. If the recipient is not a taxpayer, the sender is responsible. Art. 99 of the ADCT shared the difference between destination and origin: 20% and 80% in 2015, 40% and 60% in 2016, 60% and 40% in 2017, 80% and 20% in 2018, and 100% to the destination since 2019.
Status
In force since publication, with effect in the following year and after 90 days (art. 3). The sharing ended in 2019.
What to watch in SAP

A document from a period before 2019 can carry sharing between origin and destination. Reprocessing or auditing those years needs a percentage by year.

Tax calculation in SAP

Tax substitution6 rules

The general rule on tax substitution (ST), the base calculation, the refund, the most recent CEST change and what is already repealed. For the SAP side, see ICMS-ST and DIFAL in SAP.

In force

ICMS Agreement 142/2018

What it covers
General rule on tax substitution between states. It requires a specific agreement between the states (cl. 2), applies to Simples taxpayers or not (cl. 3), and the substitute follows the destination's law (cl. 4). The annexes list NCM and CEST by segment.
Status
In force since 01/01/2019, with 25 changes, the last being Agreement 107/26. It repealed Agreement 52/17 (cl. 34).
What to watch in SAP

The classification changes by agreement, so NCM and CEST need validity dates in the master data.

Tax master data in SAP

In force

ICMS Agreement 107/2026

What it covers
Changes Annex XX of Agreement 142/18 and splits NCM 8516.60.00 into kitchen stoves (CEST 21.046.01), portable stoves (21.047.01) and parts (CEST 21.051.01, NCM 8516.90.00).
Status
Signed on 04/09/2026 and published in the DOU of 09/09/2026. Effect on the 1st day of the 2nd month after publication (cl. 4), that is, 01/11/2026. It does not apply to São Paulo (cl. 3).
What to watch in SAP

The same NCM now has a different CEST by product. The record needs a dated CEST and the São Paulo exception.

Repealed

ICMS Agreements 81/1993, 92/2015 and 52/2017 (repealed)

What it covers
History of the ST. 81/93 had the general rules, 92/15 set up the identification of goods (the CEST) and 52/17 merged the two, with annexes by segment.
Status
Repealed. 81/93 and 92/15 left from 01/01/2018, through Agreement 52/17, which Agreement 142/18 repealed later (cl. 34).
What to watch in SAP

A rule inherited in a migration or rollout can cite a repealed agreement. List the legal basis cited in the ST rules.

Sources: 81/93 Sources: 92/15

In force

LC 123/2006, art. 21-B (ST ICMS due date)

What it covers
The states must give a minimum of 60 days, counted from the 1st day of the month of the taxable event, for the due date of ICMS owed under ST, single-stage collection and advance payment, as regulated by the Steering Committee.
Status
In force. The article was added by LC 147/2014.
What to watch in SAP

The due date of the ST payment slip is a state rule, and the due date record by state must respect the minimum. The partner's regime (Simples or not) also enters the calculation.

In force

LC 87/1996, arts. 8 to 10: ST base and refund

What it covers
The ST base adds the substitute's operation, insurance, freight, other charges and the added-value margin (art. 8, II). A final price set by a public body is the base (§ 2). Interstate ST requires an agreement between the states (art. 9). The substituted party has a right to a refund of the tax whose presumed taxable event does not happen (art. 10).
Status
In force.
What to watch in SAP

If the state does not decide the refund request in 90 days, the substituted party can take credit for the updated amount (art. 10, § 1). A final adverse decision requires reversal within 15 days (§ 2). The process needs a trigger for the credit and for the reversal.

Tax substitution in SAP (SAP Help Portal)

In force

ICMS Agreement 142/2018, cl. 11 to 20: base, refund and document

What it covers
With no price set by a public body, the ST base can be the PMPF, the final price suggested by the producer or importer, or the sender's price with freight, insurance and charges plus the MVA of the destination or of the agreement (cl. 11). The tax is the difference between the destination's domestic rate on that base and the tax of the own operation (cl. 13).
Status
In force. The tax document carries the CEST of each item in annexes II to XXVI, even without ST (cl. 20, I). Anyone not registered in the destination pays by GNRE on exit (cl. 18).
What to watch in SAP

The refund can be made by a dedicated NF-e against the substitute supplier, at the discretion of the state of the taxpayer entitled to the refund, with prior authorization within 90 days (cl. 15). A sender under Simples uses the MVA of domestic operations (cl. 11, § 1). MVA and PMPF change by state and item.

Status
In force, added by LC 214/2025.
What to watch in SAP

The system must keep the base rate of 31/12/2028 and the percentage of each year. The double clock (deadline of the act and reduction) is in State incentives in SAP.

Status
In force, LC of 13/01/2026. The form and deadlines depend on the single IBS regulation (art. 144).
What to watch in SAP

The withheld amount must be traceable by item (art. 143). With no match to the entry, the average of the entries of the last 3 months applies (§ 1).

In force, with deadline

EC 132/2023, ADCT arts. 128 and 129: rates from 2029 to 2032

What it covers
From 2029 to 2032, the ICMS rates are set at 9/10 (2029), 8/10 (2030), 7/10 (2031) and 6/10 (2032) of the rates in the law (art. 128). Incentives and benefits not reached by this reduction fall in the same proportion (§ 1). Under art. 129, ICMS ceases to exist in 2033.
Status
In force. § 2 orders the incentives of art. 3 of LC 160 to be reduced this way and rules out § 2-A. § 3 keeps to 31/12/2032 the calculation percentages of incentives already reduced by the drop in rates.
What to watch in SAP

Two clocks run together: the base rate of 31/12/2028 and the percentage of each year. LC 87, art. 31-A, repeats the reduction of 10%, 20%, 30% and 40%.

Tax reform (CBS and IBS)

In force, with deadline

What to watch in SAP

Anyone who fails to meet the condition of the granting act on time loses the right (EC 132, art. 12, § 5). The record must keep the date of the act, the conditions and the final term of each incentive.

EC 132: art. 12

In force, with deadline

LC 214/2025, arts. 388 to 392: qualification and payment of the compensation

It reaches balances whose use or refund the law of 31/12/2032 allows and that the state has approved. With no reply from the state within the period of the complementary law, the balance is deemed approved (§ 1, II).
Status
The IBS Steering Committee offsets the approved balances in 240 equal monthly installments, or over the remaining period of art. 20, § 5, of LC 87 for fixed assets (§ 3).
What to watch in SAP

A credit balance from an incentive or CIAP needs the origin date, amount and approval status by state. The form and deadlines depend on the complementary law.

In SAP

What SAP must record

Incentive code, CEST, ST, DIFAL and CIAP: what the rule asks for and what the SAP documentation describes.

Incentive code on the NF-e

Some states require the ICMS tax incentive code in the NF-e XML. In SAP S/4HANA, the activity Maintain Benefit Code for ICMS Tax creates the codes by region, with the state code and the description. The code must exist in the right region.

SAP Best Practices: ICMS incentiveState incentives in SAP

CEST on the item

The CEST has 7 digits and identifies the ST item (Agreement 142/18, cl. 6, IV). It goes on the tax document of each item in annexes II to XXVI, even without ST (cl. 20, I). The SAP Best Practices for the Brazil Nota Fiscal has the activity Determine CEST.

SAP Best Practices: Brazil Nota FiscalTax master data

Tax substitution

SAP S/4HANA derives the ST rate from the tax code, the customer or vendor record and the plant. With no ST rate, it does not calculate: there is no default rate, as there is for IPI, ICMS and ISS. The base follows Agreement 142/18, cl. 11.

SAP Help Portal: STTax setup

DIFAL and credit

The DIFAL is eligible for CIAP credit in SAP S/4HANA Cloud, alongside normal ICMS, ST and freight. The rule asks for the destination's domestic rate on the total and the difference to the destination (Agreement 236/21, cl. 2).

SAP Help Portal: CIAPTax calculation

CIAP and deadline

The default CIAP period in SAP is four-year, at most 48 months. With the limitation period defined, the limit is 60 months. After the limit, the balance goes to expense or to the original account. LC 87, art. 20, § 5, sets 1/48 per month.

ICMS alongside CBS and IBS

The SAP S/4HANA documentation for Brazil (2025 FPS02) has a customizing chapter for CBS and IBS next to the ICMS chapter. ICMS coexists with IBS until 2032, with the rate reduced each year (LC 87, art. 31-A).

Who does what

What DFSpro does and what stays with the client

DFSpro does

  • Designs and configures how SAP stores incentive, CEST, validity and DIFAL.
  • Proves the behavior with test invoices and a report of active incentives.
  • Points to the official source for each item.

The client keeps

  • Deciding the tax position and how each incentive is classified.
  • Confirming with the state and with its advisors that the incentive applies.
  • Approving the rule that will be set up in the system.

The tax position is the client's decision.

Frequently asked questions

Frequently asked questions about the law on ICMS and incentives

01Does my ICMS incentive run to 2032?+

The cap is 31/12/2032 in categories I to IV of clause 10 of Agreement 190/17. The period of your incentive comes from the state's act and can be shorter, so keep the end date of each one in the SAP master data.

02Can the state extend the incentive beyond 2032?+

In categories I to IV, clause 10 of Agreement 190/17 allows granting and extending up to 31/12/2032, and acts with a longer period must be adjusted (§ 1). The state classifies the category, and another state can challenge it within 180 days (cl. 11).

03What does Agreement 190/17 change for those who already hold an old incentive?+

It forgives credits from incentives created by law published up to 08/08/2017 (cl. 8) and allows them to be reinstated, with the acts registered at Confaz (LC 160, art. 3). Keep which act supports each incentive.

04Why does an ICMS incentive need an agreement?+

LC 24/1975 (art. 1) accepts only exemption, base reduction and presumed credit granted by an agreement ratified by the states and the Federal District (DF). Without it, the act is void and the credit of the buyer of the goods is ineffective (art. 8, I).

05How does CIAP enter the ICMS calculation?+

LC 87, art. 20, § 5, orders the fixed asset credit to be taken at 1/48 per month, times the share of taxed outbound sales. The fraction changes every month, and SAP needs the right share at each close.

06Which rule supports the DIFAL on a sale to an end consumer?+

LC 190/2022, which puts payment of the difference on the sender (art. 4, § 2, II, of LC 87). Agreement 236/2021 sets the procedure, with GNRE on exit (cl. 5), and 153/2015 covers the agreement incentive in the calculation.

07Does Agreement 107/2026 change my CEST records?+

Only if you sell stoves or parts (NCM 8516.60.00 or 8516.90.00), which get new CEST codes in Agreement 142/18, except in São Paulo (cl. 3). Effect on the 1st day of the 2nd month after publication (cl. 4): 01/11/2026.

08Are Agreements 81/93, 92/15 and 52/17 still in force?+

No. 81/93 and 92/15 were repealed from 01/01/2018 by 52/17, and 52/17 was repealed by 142/18 (cl. 34). If a rule in your SAP cites one of them, review the legal basis.

09Is Agreement 52/91 still in force for agricultural machinery and implements?+

Yes, extended to 31/12/2026 by Agreement 10/26 (ratified in the DOU of 19/02/2026). PR, RS, SC and SP may choose not to apply it, with effect from 01/05/2026 (second clause of 10/26). In those states, reversal is a rule to set up by state.

10Is Agreement 100/97 in force in 2027?+

Yes. Agreement 79/25 extended 100/97 to 31/12/2027 (cl. 1), ratified in the DOU of 25/07/2025. The 60% base reduction for pesticides, vaccines and feed applies until that date.

11How does ST calculate the base when no price is set by a public body?+

Agreement 142/18 (cl. 11) allows the PMPF, the final price suggested by the producer or importer, or the sender's price with freight, insurance and charges plus the MVA of the destination state. The choice follows the destination's law.

12Can I recover ICMS-ST if the later sale does not happen?+

Yes. LC 87, art. 10, ensures a refund, and with no decision in 90 days the substituted party can take credit for the updated amount (§ 1). Agreement 142/18 provides for the refund by a dedicated NF-e (cl. 15).

13What is the deadline to pay the ICMS on tax substitution?+

LC 123/2006, art. 21-B, requires the states to give at least 60 days, counted from the 1st day of the month of the taxable event, for the due date of ICMS on ST, single-stage collection and advance payment. The deadline of each state must be in the SAP master data.

14What happens to ICMS from 2029 to 2032?+

Art. 31-A of LC 87 cuts the rates by 10%, 20%, 30% and 40% over the four years, from the rates of 31/12/2028, and the incentives fall in the same proportion. Confaz must regulate how this applies to the incentive percentages (§ 5).

15What is the Tax Incentive Compensation Fund?+

Created by art. 12 of EC 132, it compensates from 2029 to 2032 anyone with an ICMS incentive for a fixed term and under conditions. The Union pays in BRL 8 billion in 2025, reaching BRL 32 billion in 2028 and 2029, in amounts adjusted by the IPCA.

16Who can ask for compensation from the fund, and until when?+

The holder of an onerous incentive granted up to 31/05/2023, with use to 31/12/2032. The qualification request to the Federal Revenue runs from 01/01/2026 to 31/12/2028 (LC 214, arts. 388 and 389), with prior statement by the granting state.

17What happens to the ICMS credit balance at the end of 2032?+

Art. 134 of the ADCT orders the balances existing at the end of 2032 to be used, as long as the state approves them. The IBS Steering Committee offsets them in 240 monthly installments, or over the remaining period for fixed assets.

18What does LC 227/2026 ask of those with an ST inventory in 2032?+

Art. 142 gives credit for the ICMS withheld on the inventory of 31/12/2032, in 12 monthly installments. Art. 144 requires an inventory by establishment, sent to the state and to the CGIBS, with the form and deadlines in the single IBS regulation.

19Does SAP store the ICMS incentive code of the NF-e?+

SAP S/4HANA has the configuration activity Maintain Benefit Code for ICMS Tax, which creates incentive codes by region for the states that require the code in the NF-e XML. The code must be in the right region.

20Does DFSpro say whether my incentive is valid?+

No. DFSpro configures SAP and proves the result with tests. Saying whether the incentive applies, how it is classified and which tax position to take is the client's decision, with its state and its advisors.
