Transfer pricing in SAP: the data a controlled transaction requires
Transfer pricing is the rule that compares the price of a transaction between related parties with what independent parties would agree. For the system, this becomes a data question: each transaction must leave the party, value, contract and adjustment recorded and reconciled.
DFSpro's task is to design the data and prove that the SAP environment delivers it. Method, comparables and tax position belong to the client and to the client's advisers.

A data problem before it is a problem of price
SAP keeps the facts of the transaction. Law 14.596/2023 requires the company to show, with data, that the price charged to a related party abroad respects the arm's length principle, meaning the price independent parties would agree.
What the system answers
How much, when, with whom, under which contract, in which account, with which document and with which adjustment. It is the company's side of the comparison.
What the system does not answer
Which method is the most appropriate, which market comparables apply and what range is acceptable. These are decisions and sources outside the ERP.
What the law reaches
IRPJ and CSLL (Brazil's corporate income taxes) of legal entities based in Brazil with controlled transactions with related parties abroad, under the actual profit, presumed profit or arbitrated profit regime.
The law deals with income tax. The calculation of these taxes is on the page for IRPJ and CSLL calculation, and the declaration of the transactions continues in the ECF.
The rules and the manual that decide what the system must keep
Each rule defines one piece of what the company must show: the rule, the proof and the declaration.
Law 14.596/2023
Sets the transfer pricing rules for IRPJ and CSLL. In force since 01/01/2024, with an option to adopt from 01/01/2023 (arts. 45 and 47).
IN RFB 2.161/2023
Regulates the law. It was amended by IN RFB 2.246/2024 and 2.249/2025 and, from 2024, repealed IN RFB 1.312/2012 (art. 80).
OECD (OCDE) Guidelines
The IN treats the 2022 OECD report as a secondary source of interpretation, when approved by the tax authority and as long as it does not conflict with the law and the RFB rules (art. 1, paragraph 4).
ECF manual, layout 12
Defines records X360 to X375, where the company declares controlled transactions. Annex to ADE Cofis 02/2026, April 2026 update.
Global and Local Files
The documentation delivered through e-CAC (the tax authority's online service), within three months after the ECF deadline (IN, arts. 55 and 56).
Commodities registration
The export or import contract for commodities is registered in e-CAC by the tenth day of the month after it is signed (IN, art. 64).
The general map of income tax rules that touch SAP is on the legislation page.
Eight kinds of link and the data each one needs
The system only knows that a transaction is controlled if the partner record says what the link is.
| Case (art. 4, paragraph 1) | In plain words | Data worth keeping in the master record |
|---|---|---|
| I: controlling and controlled entities | One entity controls the other. | Chain of control and shareholdings. |
| II: an entity and its business unit | Head office and branches treated as separate taxpayers for income tax. | Link between establishments and the tax treatment of each. |
| III: affiliates | Significant influence of one over the other (art. 243 of Law 6.404/1976). | Shareholding percentage and the test of influence. |
| IV: entities in the consolidated statements | Entities that are, or would be, included in the consolidation of the group's final controller. | Group consolidation perimeter. |
| V: right to 25% of profits or assets | One may receive 25% or more of the other's profits or assets on liquidation. | Percentage of right to profits and assets. |
| VI: common control or 20% of capital | The same control, or the same partner with 20% or more of the capital of each. | Common partner and capital percentages. |
| VII: same partners and relatives | Partners, spouses or relatives up to the third degree with 20% or more of the capital of each. | Family relationship and shareholding. |
| VIII: entity and individual | Spouse or relative up to the third degree of a board member, officer or controller. | Relationship with the managers. |
Paragraph 1 applies without prejudice to other cases: the underlying test is influence that leads to conditions different from market ones. The IN extends control to transactions with entities covered by arts. 24 and 24-A of Law 9.430/1996. The link changes over time, so the master record needs validity dates.
Thirteen transaction codes and where each one comes from in the system
The law defines a controlled transaction as any commercial or financial relationship between related parties, direct or indirect, including contracts and arrangements (art. 3).
Commodities, codes 01 and 02
Export and import of commodity goods. It starts at export billing, at import entry and at the contract that fixes the price.
Other goods, codes 12 and 13
Export and import of goods. It starts in sales and purchases with a related party abroad, with NCM (the Mercosur product code) and country on each item.
Services, codes 03 and 04
Export and import of services. It starts in accounts receivable and payable for services, which may have no source invoice.
Rights and intangibles, codes 05, 06, 09 and 10
Assignment and use of rights, royalties, licenses, franchises, patents, trademarks and know-how, with the contract and linked payments.
Financial operations, codes 07 and 08
Loans, interest, leasing, guarantees and balances between the companies, which start in financial accounting.
Cost sharing, code 11
Allocations between group companies, usually posted in cost control, with their own allocation key.
The ECF separates 13 transaction codes, grouped above. The origin shown is typical, and each environment has its own design: the inventory of controlled transactions shows where each type starts and who answers for it.
Nine data items the documentation asks for and the source of each
The IN requires the Local File to carry these items, and the ERP covers only part of them.
| Data | Where the rule asks for it | Source |
|---|---|---|
| Counterparty: name, country and link | IN, art. 59, II, and art. 61, I | Partner master data in SAP |
| Description, value and context of each transaction | IN, art. 59, III | Documents and postings in SAP |
| Contract terms: price, calculation method, review, payment, duration, penalties | IN, art. 59, III | Contract and conditions in SAP |
| Goods, rights or services of the transaction | IN, art. 59, III | Material and service master data |
| Functions, assets and risks of each party | Law, art. 7, II; IN, art. 59 | Client analysis, outside the ERP |
| Method, indicator and tested party, with the reasoning | IN, art. 59, IV, and art. 61, III and V | Client decision, outside the ERP |
| Resulting comparables and range | IN, art. 61, IV | External sources, plus internal comparables in SAP |
| Voluntary and compensating adjustments of the year | IN, art. 61, VI | Ledger and adjustment documents |
| Copy of the contracts | IN, art. 59, III | Contract archive |
Six lines come from SAP, two depend on client analysis outside the ERP and one mixes the two sources. Treating the groups separately avoids asking the system for what it does not have and forgetting what it has.
Six points the law requires you to look at before any comparison
The law's first step is to describe the transaction as it actually happens, and the ERP is a source for that description.
Contract terms
They come from formal contracts and from evidence of the parties' actual conduct (Law, art. 7, I). The system keeps contracts, amendments, orders, invoices and payments.
Functions, assets and risks
Who performs each function, with which assets and which economically significant risks. The risk stays with whoever controls it and has the financial capacity to bear it (paragraph 4).
Goods, rights and services
The specific characteristics of the object of the transaction (item III). The system keeps the item master record and the specification of each sale or service.
Economic circumstances
The circumstances of the parties and of the market they operate in (item IV). This is client information, and the ERP contributes the history of volume and price.
Business strategies
The strategies and other economically relevant characteristics (item V). This is also client information.
Realistically available options
The law requires you to consider each party's options, including not carrying out the transaction (paragraph 1).
When the characteristics in the contracts and documents differ from those that result from the facts and the parties' actual conduct, the transaction is delineated by the conduct (art. 7, paragraph 2). For the system, orders, shipments, invoices and payments are evidence of conduct. A contract that says one thing and a document flow that shows another is the difference the law tells you to resolve by the facts.
What SAP's help describes for selling and billing inside the group
The price of a transaction between group companies starts in documents with different origins and roles.
- 01
Customer order
The end customer orders from the selling company.
- 02
Intercompany order and delivery
The delivering company receives the intercompany order and makes the delivery and goods issue.
- 03
Two invoices
The customer invoice (type F2) and the intercompany invoice (type IV2) are created with reference to the delivery, after the goods issue.
- 04
Entry at the selling company
The selling company posts the intercompany invoice as a purchase, because it buys the goods to resell them.
Where each price comes from
The price of the customer invoice comes from the selling company's order. The price of the intercompany invoice comes from the delivering company's intercompany order. The quantity comes from the delivery.
Optional pro forma invoice
Type IV3 is used, in exports, to give customs evidence of the cost of the goods. It is not a payment request.
Accounts payable between companies
The S/4HANA Cloud help describes the configuration to post accounts payable documents between group companies, including the tax code of those postings.
The document types named are those of the standard Customizing delivered with client 000, and each environment may use others. The help describes the flow between companies in the same system. With a counterparty abroad outside it, the data may come in another way, such as export billing, accounts payable or a manual posting.
SAP Help Portal, S/4HANA, version 2025 FPS02: Billing in Advanced Intercompany Sales. S/4HANA Cloud, version 2608: Intercompany Billing.
SAP's transfer price and the law's transfer price are not the same thing
The ERP uses the phrase for inventory and result valuation. The law uses it for the tax base.
Transfer price is the price used to value the passage of a good or service between units that operate independently inside a business organization.
Legal view
Values what passes between legally independent group companies, including the sales price. It appears in each company's individual statements.
Group view
Uses the cost of production to allocate goods and services inside the group, removing intercompany profit from the prices of the legal view.
Profit center view
Uses management prices agreed between areas of responsibility to measure internal profitability.
The help records that the system can keep up to three valuation approaches in parallel, in a currency and valuation profile, and that activities are not valued by these prices at that point. For services between group companies, the help does not describe this valuation.
SAP's transfer price is a valuation concept. The proof that a price respects arm's length comes from the method, the comparables and the analysis the law requires. One piece of data does not replace the other, and the client decides how each enters the documentation.

Services, royalties, interest and allocations: the data the posting must carry
Most of what the law calls a controlled transaction does not go through goods billing.
Services
The law defines them as any activity that brings a benefit to the other party (art. 23). A shareholder activity and a duplicated service do not create a benefit. The system keeps who received it, which benefit and the proof of delivery.
Intangibles and royalties
The law asks for the identification of the intangible, its ownership and who performs the functions of development, maintenance, protection and exploitation (arts. 19 to 22 and IN, art. 60). The system keeps the contract, the owner and the payment flow.
Cost sharing
Related parties share contributions and risks in proportion to each one's benefits (art. 25). The system keeps the allocation key and the cost base of each period.
Debt and interest
The law decides whether a financial resource is debt or capital and sets the remuneration according to arm's length (arts. 27 to 29). The system keeps principal, term, rate, currency and balances.
Guarantees and centralized cash
A guarantee delineated as a service and the centralization of cash balances have their own rule (arts. 30 to 32). The system keeps the commitment, the beneficiary and the balance.
Restructuring and insurance
Changes in the relationships between the parties that transfer potential profit, and insurance between related parties, follow arts. 26 and 33. The system keeps the date, the functions and the assets that changed.
These operations may be accounting postings, with no source invoice. The risk is not having a key that finds them later. The common key with the partner master data and the ECF transaction code solve that search.
Six methods and the data each one requires from the system
The law lists the accepted methods. For the ERP, each one is a list of fields with the same operation key.
| Method (art. 11) | What it compares | Data the system can deliver |
|---|---|---|
| PIC: comparable uncontrolled price | The price or consideration of the transaction against those of comparable transactions between unrelated parties. | Unit price, quantity, date and payment terms, per transaction. |
| PRL: resale price minus profit | The buyer's gross profit rate on resale to unrelated parties against comparable gross profit rates. | Resale revenue and cost of the goods bought from the related party, linked by transaction. |
| MCL: cost plus profit | The gross profit rate on the supplier's costs against comparable profit rates. | Base of direct and indirect costs of the good or service and the rate applied. |
| MLT: transactional net profit rate | The net profit rate of the transaction against comparable net profit rates, with an appropriate profitability indicator. | Result of the transaction, with the allocation of costs and expenses. |
| MDL: profit split | The split of profits or losses according to each party's contributions. | Joint result and the functions, assets and risks of each party. |
| Other methods | An alternative methodology that produces a result consistent with that of independent parties. | Own design, case by case. |
Choosing the method is the client's decision: the law requires the most appropriate one, based on functions, assets, risks, availability of comparables and the degree of comparability (art. 11, paragraph 1). The system delivers the indicator the chosen method asks for, without manual rework.
Six blocks of the comparability analysis and what stays inside and outside SAP
The IN lists seven typical steps, with no linear order (art. 21). Six blocks, and some of them use data from the system.
- 01
Period and internal comparables
Define the period of the analysis and check whether the company itself has the same transactions with unrelated parties (IN, art. 21, I and II).
- 02
Sources of external comparables
Identify the available sources and the reliability of each. This step is outside the ERP.
- 03
Method, indicator and tested party
Select the method, the profitability indicator and the tested party, with documented reasoning (Law, art. 15).
- 04
Comparables and comparability adjustments
Identify the potentially comparable transactions and make reasonably accurate adjustments.
- 05
Range and conclusion
When the method gives a range of observations, the appropriate range decides whether the terms respect arm's length (Law, art. 16).
- 06
Reproducing the search
If the tax authority asks, the taxpayer reproduces the searches of the databases used to select the comparables (IN, art. 63).
Internal comparables are the prices the company itself charges unrelated parties. They are in SAP, and extracting them with the same criteria as the controlled transaction is data work. External ones come from third-party databases.
Three types of adjustment and the trail the compensating one requires
The compensating adjustment changes the value of the transaction on both sides. The system must record the change in a way the audit can rebuild.
Voluntary adjustment
The Brazilian company adds to the tax base the result it would have obtained if the transaction followed arm's length (Law, art. 17, I).
Compensating adjustment
The parties to the transaction adjust the value, so as to reach the result of independent parties (Law, art. 17, II).
Primary adjustment
The tax authority adds to the tax base the result the company failed to report (Law, art. 17, III).
How the compensating adjustment must appear
| Condition (IN, art. 50) | What the rule says | What SAP must show |
|---|---|---|
| Symmetry | Symmetric and final bookkeeping at both ends, with the same value and the same nature. | A posting in Brazil linked to the transaction, and evidence of the counterparty's posting. |
| Document | A debit note, credit note or tax and commercial document that shows the nature and amount. | The adjustment document, with a reference to the original transaction. |
| Counterparty statement | A statement from the other party's legal representative that it made the same adjustment, certified by the Brazilian company's representative. | The statement file, linked to the adjustment. |
| Deadline | It can be made up to the delivery of the ECF, with permanent record in the books of the calendar year of the transaction (paragraph 2). | Date of the adjustment and accounting period of the record. |
| Entities under arts. 24 and 24-A | The compensating adjustment cannot refer to transactions with entities covered by arts. 24 and 24-A of Law 9.430/1996 (item IV). | The partner's flag for this status in the master record. |
| Direction | The adjustment cannot reduce the tax base or increase the loss, except the compensating one under the conditions of art. 50 and the results of an international agreement (art. 49, paragraphs 3 and 4). | Sign of the adjustment and target account. |
When the adjustment increases the tax base or reduces the loss, items III and IV of art. 50 do not apply (paragraph 3). The ECF asks for the value of the adjustment in the transaction and the accounts used in record X371.
Four checks between the transaction, the adjustment and the ledger
The declaration of controlled transactions only holds up if the values match the accounting.
- 01
Value before adjustments
The ECF asks for the value of the transaction before the transfer pricing adjustments. The report starts from the ledger and the result accounts of each transaction.
- 02
Adjustments in their own account
Voluntary and compensating adjustments sit in separate accounts, so the original value and the adjustment can be read without ambiguity.
- 03
Compensating adjustment accounts
Record X371 uses the account code of the taxpayer's chart of accounts (J050) and, where there is one, the cost center (J100), with the balance used and the debit or credit indicator.
- 04
Totals by type
The total of each ECF transaction code must close with the sum of the transactions of that type in the ledger.
The difference report follows the method of the page on tax and accounting reconciliation, with one more key: the entity code, set by the company itself in the ECF.
SAP's help describes SAP Intercompany Reconciliation, which reconciles documents between group companies and their business partners in three processes: open ledger items, ledger accounts and customer and vendor items. It works in the transaction currency, in selection, assignment and reconciliation. The help also lists Intercompany Matching and Reconciliation.
Source: SAP help, S/4HANA, version 2025 FPS02: SAP Intercompany Reconciliation.
The central piece: a list with key, original value and adjustment
DFSpro designs this report together with the company's areas. Without it, the Local File and the ECF may depend on spreadsheets rebuilt every year.
Operation key
An identifier that links document, posting, contract and partner, the same on both sides of the comparison.
Counterparty
Entity code, name, country and link, with the same key as record X365.
Type and country
ECF transaction code and country of residence, to close with X370.
Original value
The value before the transfer pricing adjustments, which is what the ECF asks for.
Adjustments
Voluntary value and compensating value, in separate columns, with the document of each.
Account and evidence
Ledger account and cost center of the adjustment, and the contract or document that supports the line.
Run every year with the same criteria, the report builds a comparable historical series. Three design choices define its quality: the key between transaction and contract, the level of totals and who may change a line already delivered.
Three value bands and three documents
The size of the obligation depends on the total value of controlled transactions of the previous year.
| Sum of controlled transactions in the previous year, before adjustments | Local File | Global File |
|---|---|---|
| BRL 500,000,000.00 or more | Complete, with arts. 59 and 60 | Required |
| BRL 15,000,000.00 or more and less than BRL 500,000,000.00 | Simplified, under art. 61 | Required |
| Less than BRL 15,000,000.00 | Exempt | Exempt |
Country-by-Country Report
Reports the global allocation of revenue and assets and the tax paid by the group. The IN refers it to IN RFB 1.681/2016 (art. 55, paragraph 1).
Global File
Structure and activities of the multinational group: organization chart, functions, assets and risks, supply chain and intangibles (art. 58).
Local File
The controlled transactions, the parties, the methods, the comparables and the adjustments of the year (arts. 59 to 61).
The Local File lists the largest transactions of goods and of services that add up to 80% of the total of each type. Commodities, rights, restructurings, cost sharing, financial operations and intangibles enter in full (art. 57, paragraph 2). The limit applies to the list, and the transfer pricing rule applies to all transactions.
Six records of block X where the transaction becomes a declaration
The ECF receives the transactions in its own records, and each one has a data source in the environment.
X360
Carries: general information on transfer pricing, in lines of code, description and value from the tax authority's dynamic table. System data: the company's general answers, which the client provides.
X365
Carries: the counterparties, with the entity code, set by the company itself, and the name. System data: partner master data with the code used in the other lines.
X366
Carries: value lines on the entities with which there are controlled transactions, by code of the tax authority's table. The manual gives the total of payments as an example. System data: totals by counterparty.
X370
Carries: each controlled transaction, with type, country, NCM (for goods), description, value before adjustments and values of the voluntary and compensating adjustment. System data: values by counterparty and by transaction type, with the country.
X371
Carries: ledger accounts and cost centers of the compensating adjustment, with the balance used and the debit or credit indicator. System data: adjustment ledger accounts, equal to those of the taxpayer's chart of accounts in the ECF.
X375A to X375E
Carries: information on the method adopted (PRL, MCL, MLT, MDL and PIC), in dynamic tables. System data: the indicators of the method the client chose.
The records must be filled in by everyone who has controlled transactions, even those exempt from the Local File. They appear when block 0 shows operations abroad and with a related person. The ECF itself, with e-Lalur and mapping, is on the page for ECD and ECF.
ECF manual, layout 12 (ADE Cofis 02/2026, April 2026): records X360 to X375.
The TDF creates the ECF report, and what remains is to check the scope
The report exists. The question is which block X records it delivers in your environment.
ECF report in the TDF
The help for SAP Tax Declaration Framework for Brazil (version 1.0, SP20) lists the ECF among the SPED reports the product creates.
Tracking and submission
The Tax Obligation Monitor shows the progress of each run and makes the file available to download and send to the tax authority.
Supported records
The help refers to SAP note 2248350 for the detail of the records the product supports.
Checking whether records X360 to X375 are in the scope of the environment is a record-by-record check. What is left out comes in through an extension or a tool of its own, designed so the file keeps coming out of the same flow. The TDF page describes the product.

Contract registration in e-CAC by the tenth day of the following month
Commodities have their own obligation, built around the contract and not the invoice.
Contract identification
Data of the contract, the declarant and the parties (IN, art. 38, I and II).
Commodity and transaction
Information on each commodity and the details of the transaction (art. 38, III, a and b).
Price and date
Price or pricing criterion, adjustments and the date or range of dates used to fix the price (art. 38, III, c and d).
Sources and method
The reference sources of the pricing and the transfer pricing method adopted (art. 38, IV and V).
The deadline is the tenth day of the month after the contract is signed, whatever its form (art. 64, as worded by IN RFB 2.249/2025). The date that triggers it is the contract date, and the system must keep it.
Renegotiating or extending the contract requires a new registration, with the number of the original registration (art. 64, paragraph 3). The registration is required even if the PIC method ends up not being used (art. 38, paragraph 1, I). The page on foreign trade covers the import and export flow.
A simplified rule that still asks for a cost base and allocation
The simplified approach replaces the comparison with a fixed profit rate, but the proof of cost is still needed.
| Point of the rule (IN, art. 53) | What the rule says |
|---|---|
| The option | Instead of comparing, the taxpayer may remunerate the low value-added service with a gross profit rate on all direct and indirect costs. |
| The limits of the rate | At least 5% when the provider is the Brazilian company. At most 5% when the provider is the related party abroad. |
| What the service must be | A support service, outside the main activity, with no unique and valuable intangible, no significant risk and no relevant contribution to the group's value. |
| What rules it out | A service that the group also provides to unrelated parties is not low value-added (paragraph 2). |
To use the rule, the system must show the cost base of the service and the allocation criterion between group members, proportional to each one's benefits (art. 53, paragraph 3). The same data serves cost sharing. The decision to opt for the approach is the company's.
Five dates and one permanent rule of the transfer pricing cycle
Each date depends on a data item the system must have ready before it.
- 01
Day 10 of the month after the contract
Registration of the commodity contract in e-CAC (IN, art. 64).
- 02
End of the calendar year
Deadline for the compensating adjustment under the rule's definition (IN, art. 48, II). Art. 50, paragraph 2, allows it up to the delivery of the ECF, with permanent record in the year of the transaction.
- 03
Last business day of July
Submission of the ECF for the previous calendar year (IN RFB 2.004/2021, art. 3).
- 04
Three months after the ECF deadline
Global File and Local File, through e-CAC (IN, art. 56).
- 05
Thirty days from the Notice of Findings
Deadline to amend the ECF and the DCTF, only for the transfer pricing adjustments (IN, art. 67).
- 06
Throughout the year
Supporting documents are organized contemporaneously with the transactions and kept available to the tax authority (IN, art. 62).
The ECF deadline and the amendment follow the page for ECD and ECF.
What the law sets for information that is late, incorrect or missing
System data reaches the tax authority through declaration and documentation. When they fail, the rule provides a penalty for each situation.
| Situation | Penalty | Legal basis |
|---|---|---|
| Failure to deliver the declaration or ancillary obligation on time | 0.2% of the gross revenue of the period, per calendar month or fraction | Law, art. 35, I, a |
| Delivery with inaccurate, incomplete or omitted information | 5% of the transaction value or 0.2% of the group's consolidated revenue in the previous year, as the case may be | Law, art. 35, I, b |
| Delivery that does not meet the requirements of the obligation | 3% of the gross revenue of the period | Law, art. 35, I, c |
| Failure to provide information or a document requested in a tax procedure, or obstruction of the inspection | 5% of the transaction value | Law, art. 35, II |
| Global or Local File late | 0.2% of the gross revenue of the period, per calendar month or fraction | IN, art. 66, I, a |
| Global or Local File that does not meet the requirements | 3% of the gross revenue of the period | IN, art. 66, I, b |
Each penalty has a minimum of BRL 20,000.00 and a maximum of BRL 5,000,000.00 (art. 35, paragraph 1). The penalty for inaccurate information does not apply to proven formal errors or to immaterial information, under the conditions the tax authority regulates. Applying it to a specific case is for the client and the client's accountant.
Thirty days, per transaction, and the trail that supports the amendment
An amendment only works if the company can reprocess a whole transaction in a few days.
- 01
Notice of Findings
When the authority disagrees with the tax base, it notifies the taxpayer by Notice of Findings, before the assessment (IN, art. 67).
- 02
Thirty days to amend
The taxpayer may amend the ECF and the DCTF, only for the transfer pricing adjustments.
- 03
Amendment per transaction
Each controlled transaction is a matter of its own, and a partial amendment of it is not accepted (art. 67, paragraph 3).
- 04
Effect on the penalty
If there is a tax credit, the ex officio penalty does not apply when it is paid in full with late-payment charges by the deadline (paragraph 5).
The rule makes the benefit depend on four requirements of the taxpayer: not acting against a binding normative act, being cooperative, making reasonable efforts and adopting coherent and justifiable criteria (paragraph 1). The system helps by showing the trail: who prepared each data item, when and with what criteria.
Three instruments of the law and the history that supports them
The law provides instruments to give predictability to those with controlled transactions.
| Instrument | What the law says | Data that helps |
|---|---|---|
| Specific consultation (art. 38) | The tax authority may set up a consultation process on the methodology to be used in future controlled transactions. | Description of the future transactions, with expected volumes and conditions. |
| International agreement (art. 39) | A result agreed in a dispute resolution mechanism of an international agreement or convention leads to an ex officio review of the assessment. | History of the transaction and of the adjustments by year. |
| Specific rules (art. 37) | The tax authority may issue rules for given situations, such as simplifying the comparability analysis. | Versioned master data, which follows the rule. |
These are paths of decision between the client and the tax authority. The system does not choose any of them, but the quality of the history decides whether the company can use any one without rebuilding the data.
What changed in 2023 and 2024 and what that requires of the master data
Whoever has operated for years with related parties carries contracts from the earlier regime.
Option in 2023
The law allowed the new rules to apply from 01/01/2023. The IN set the option window between 01/09/2023 and 31/12/2023, by digital process in e-CAC, irrevocable (arts. 69 and 70).
Mandatory in 2024
Initial adoption took place on 01/01/2024 for those who did not opt in (IN, art. 72). IN RFB 1.312/2012 was repealed on that date (art. 80).
Earlier contracts
The rules also apply to contracts and operations of earlier periods whose effects on the tax base occur after the adoption dates (art. 73).
Flag in the ECF
The field that showed the 2023 option existed only in ECF layouts 10 and 11, and layout 12 no longer has it.
For the system, the practical effect is the historical series: contracts signed before 2024 may have effects afterwards, and the contract start and review data must be in the master record.
Eight mistakes that make data reach the documentation wrong
The origin may be in a process or in master data, and not only in the calculation.
| Mistake | Why it happens | How to avoid it |
|---|---|---|
| Treating SAP's transfer price as proof under the law | The name is the same, but the ERP valuation is a management and reporting concept. | Separate the ERP valuation from the arm's length analysis, and document both. |
| Transaction without an entity code | The posting starts in accounts payable or in a manual posting, with no link to the partner master data. | A common key between partner, posting and ECF transaction code. |
| Adjustment without a document | The adjustment is made only in the ledger, with no debit or credit note. | An adjustment document linked to the original transaction, with date and value. |
| ECF value after the adjustment | X370 asks for the value before adjustments, and the report shows the net value. | Two columns in the report: original value and adjusted value. |
| X371 account outside the ECF chart of accounts | The adjustment uses an account that is not in the ECF record J050. | Reconcile the adjustment accounts with the ECF chart of accounts before generating the file. |
| Contract without a signing date | The commodity record uses the contract date, which is not in a structured field. | A field of its own for the signing date, with validity and renegotiations. |
| Allocation without a key | The shared cost is distributed by a criterion nobody documented. | A versioned allocation key, with the cost base of each period. |
| Comparables search without a record | The search in the third-party database left no trail. | Keep the search, the date and the filters, to reproduce it if the tax authority asks. |
The mistake may be in the handover between areas. Tax defines the rule, controllership posts the value and IT maintains the master data. The reconciliation links the three ends.
Six questions to measure the readiness of the data
An answer of "I don't know" points to where next year's documentation will fail.
Inventory
Is there a list of the transactions with related parties abroad, by ECF type, with an owner for each?
Master data
Does each related partner have a link, a percentage and a validity date in the master record?
Contracts
Are the signing date, the validity and the renegotiations of the contracts in a structured field?
Adjustments
Does the compensating adjustment have a document, an account of its own and a link to the original transaction?
Original value
Does the report show the value before and after the adjustments, per transaction?
Amendment
Can the company reprocess a whole transaction in a few days, with the trail of changes?
From the inventory of transactions to proof in a closed period
Six system deliveries, in order. The controlled transactions report is the center.
- 01
Inventory of transactions
A survey of the environment's controlled transactions, by ECF type, with the source of the data and the person responsible.
- 02
Partner and contract master data
Design of the fields for link, validity, signing date and renegotiation.
- 03
Controlled transactions report
A report by operation key, with original value, adjustment and account, reconciled with the ledger.
- 04
Adjustment trail
Record of the document, account and date of the voluntary and compensating adjustment.
- 05
ECF check
Comparison of the generated X360 to X375 records with the report, and extension of what is left out.
- 06
Proof in a closed period
Reproduction of a year already declared, to show that the report reaches the same value.
It can start with a SAP Tax Diagnostic or at the end of a migration to S/4HANA.
If the configuration needs code, the tax ABAP developmentcomes in, and the behavior is proved with the tax testing.
Who proves and who decides
The system shows what happened. What the company does with it is the decision of whoever answers for it.
DFSpro designs fields and reports and proves, with the environment's data, what SAP delivers. The tax decision belongs to the client.
DFSpro designs and proves
- Where each data item of the transaction starts in the system.
- That the report and the ECF agree with the ledger.
- That the adjustment trail repeats every year.
- That a closed period is reproduced with the same value.
The client and the tax adviser decide
- Which transfer pricing method to apply and why.
- Which comparables to use and which range to adopt.
- Whether an adjustment should be made and of what type.
- How the company positions itself before the tax authority and who signs the documentation.
DFSpro does not issue opinions, does not choose a method and does not set a target price. The position, the classification and the result of a controlled transaction belong to the client and the client's advisers.

Common questions about transfer pricing in SAP
01Does DFSpro define the transfer pricing method?+
No. The method, the comparables, the range and the position belong to the client and the client's tax advisers. DFSpro designs the data, sets up the reports in SAP and proves that the system delivers the indicator the chosen method asks for.
02What does DFSpro deliver inside SAP?+
An inventory of controlled transactions, partner and contract master data fields, a transactions report with original value and adjustment, the adjustment trail and a check of the ECF records. When the environment lacks a feature, the extension is designed to enter the same flow.
03Does standard SAP already do transfer pricing?+
SAP's help treats transfer pricing as inventory and result valuation between units. Billing and reconciliation between group companies are separate features. The arm's length analysis of Law 14.596/2023, with method and comparables, is not in what these pages describe.
04Do I need GUEPARDO Tax for this?+
No. The data design starts from the SAP the company already has. GUEPARDO Tax belongs to NTT DATA, and DFSpro offers it as an Authorized Channel, but this work does not depend on it.
05Does it work for S/4HANA and for ECC?+
The survey starts with the inventory of the environment's transactions, whether S/4HANA or ECC, and shows the path of each type of operation and how to extract the data.
06Who in the company needs to take part?+
International tax, controllership, accounting and SAP IT. Tax defines the rules, controllership and accounting answer for the value and the adjustment, and IT maintains the master data and the reports.
07What should the company gather before the survey?+
The list of related parties abroad, the contracts in force, the last Local File or the previous year's documentation and access to the ledger data. The rest is built together during the survey.
08How is the scope set?+
Through the contact page. The company presents the environment, the transaction types and the documentation it prepares today, and the scope and the order of deliveries come from that picture. Commercial terms are set with the company after the scope of the work is clear.
09Who signs the transfer pricing documentation?+
The company and the advisers it chooses. DFSpro does not sign or issue opinions. It delivers the data and the proof of the system's behavior, and the tax position stays with the client.
10Which SAP data does the survey check first?+
Partner link and validity, contract signing date, the ECF transaction code, the adjustment document and the key that links a posting without an invoice to the partner. Gaps are measured before any design.
11Is a company under BRL 15 million free of the rule?+
It is exempt from the Global File and the Local File, but the IN says the rules apply to all controlled transactions and that the ECF records are filled in by whoever has them. The exemption is from the document, not from the rule.
12What happens if the tax authority disagrees with the value?+
The authority must notify by Notice of Findings before the assessment, and a company that meets the requirements can amend the ECF and the DCTF within 30 days, only for transfer pricing. This requires reprocessing the transaction with a trail.
Bring the list of transactions with related parties and the documentation from last year
Describe the transaction types and how the data is gathered today. The reply starts from your environment, the ECF records and who decides each point, with no price and no commitment on deadline.
