Tax credit recovery in SAP: how a credit is born, booked and proven

ICMS, IPI, PIS and COFINS create a credit when you buy, but the credit only counts as cash when the law grants the right, the document proves the transaction and the books record the credit on time. In SAP, that path runs through tax setup, master data and tax files, and that is where credits tend to get lost.

This page shows how the input credit, the fixed asset credit, the exclusion of ICMS from the PIS and COFINS base, prior-period credits, refunds and offsetting work, and how a team should check each one. It does not promise a value: it shows the way to reach one with proof.

Direct answer

A tax credit is not recovered: it is proven

A tax credit is the right to deduct from the tax you owe the tax already paid earlier in the chain. It is born when you buy, but it only counts if three things hold: the law grants the right, the document proves the transaction and the books record the credit on time. If one is missing, the credit exists only in someone's expectation.

In SAP, these three things pass through different places. The right depends on the tax setup. The proof depends on the electronic tax document and on master data. The booking depends on whoever builds the file for EFD ICMS IPI and for EFD-Contribuições. When a credit "disappears", it was almost always lost in the handoff from one of these places to the next.

This page covers ICMS, IPI, PIS and COFINS: input credit, fixed assets, the exclusion of ICMS from the PIS and COFINS base, prior-period credit, refunds and offsetting. It closes with the bridge to the CBS and IBS credit. What follows explains the mechanism and how a team should run it; it is not legal advice, and the decision to claim, offset or dispute a credit belongs to whoever is legally responsible for the company.

A word on method. No number here tells you how much your company can recover. That value only appears after checking document by document, and it can be high, low or zero. The text shows the way to reach it with proof.

Map

Four taxes, four mechanics

Treating credit as one single thing gets all four wrong. Each tax has its own credit trigger, its own restrictions and its own deadline. The cards summarize; the sections that follow open each point.

ICMS

State tax

Credit on the purchase of goods, on use and consumption (from 2033), on fixed assets in 48 installments and on transport and communication.

Reversal is mandatory when the later sale is not taxed, the goods perish or go to an unrelated purpose. The deadline is 5 years from the issue date of the document.

IPI

Federal tax

Basic credit on raw materials, intermediate products and packaging used in a taxed product, at an industrial or equivalent establishment.

A credit balance accumulated in the quarter can be used under Law 9.430, arts. 73 and 74.

(Source: IPI Regulation)

PIS and COFINS

Federal contributions, non-cumulative regime

Credit on resale goods, inputs, rent, energy, fixed assets and other items of art. 3, calculated only on costs linked to non-cumulative revenue.

Requires a supplier that is a legal entity in Brazil. A credit from one month can be used in the following months.

(Source: Law 10.637)

CBS and IBS

New taxes from the reform

Credit arises when the supplier's liability is extinguished, is taken separately for each tax and is proven by an electronic tax document.

An exempt, immune or zero-rate transaction creates no credit. A credit balance can be refunded.

(Source: LC 214)

Behind the four cards there is one common rule, and it is the one SAP must be checked against: the credit follows what happens after the purchase. If the next sale is taxed, the credit stays. If the sale is exempt or not taxed, the law bars the credit or requires a reversal. The ERP (enterprise resource planning system, such as SAP) must know at purchase time where the goods will probably go, and it must correct the credit when that destination changes.

Where credit starts

How a credit is born

Before touching SAP, keep the four cards below in mind. They separate what creates the credit, the condition that keeps it and the place where it appears in the books.

  • ICMS

What creates the creditGoods received, actual or symbolic, including for use or consumption and fixed assets, and interstate and intermunicipal transport and communication services.

Core conditionValid documentation and, where required, booking within the legal deadlines. Exempt or non-taxed inputs and inputs unrelated to the business give no credit.

Where it is bookedEFD ICMS IPI, which replaces the tax ledgers and the CIAP.

(Source: LC 87, arts. 20 and 23) (Source: Ajuste SINIEF 02/09)

  • IPI

What creates the creditRaw materials, intermediate products and packaging bought to be used in making taxed products.

Core conditionIndustrial or equivalent establishment. Non-cumulativity works as a system that offsets the tax on inputs against the tax on outputs.

Where it is bookedIPI assessment of the establishment, as set by the regulation.

(Source: IPI Regulation, arts. 225 and 226)

  • PIS and COFINS

What creates the creditGoods for resale, inputs, rent, energy, machinery and fixed asset equipment, among other items of art. 3.

Core conditionLegal entity under the non-cumulative regime; supplier that is a legal entity based in Brazil; link to revenue subject to the regime.

    Where it is bookedEFD-Contribuições.

(Source: Law 10.637, art. 3) (Source: Law 10.833, art. 3)

  • CBS and IBS

What creates the creditPurchase of goods or services whose CBS and IBS liability was extinguished by one of the methods in art. 27.

Core conditionValid electronic tax document; credit taken separately for each tax, with no cross-offsetting.

Where it is bookedAssessment of the new taxes.

The three locks that apply to all

01

The right

The law describes what gives credit and what does not. For ICMS, an input linked to an exempt or non-taxed sale is barred, except for exports, and the law requires a reversal when the destination changes (Source: LC 87, arts. 20 and 21). For PIS and COFINS, credit only covers purchases from a legal entity based in Brazil (Source: Law 10.637, art. 3, § 3).

02

The proof

The ICMS credit depends on valid documentation (Source: LC 87, art. 23). For CBS and IBS, the proof is a valid electronic tax document (Source: LC 214, art. 47, § 1). A rejected, canceled or wrong document brings the credit down, and the ERP is the one that holds that document.

03

The record

A credit that is not booked on time can be lost. For ICMS, the right to use the credit ends five years after the document issue date (Source: LC 87, art. 23, sole paragraph). For a PIS and COFINS credit that crosses the reform, the law requires it to be recorded in the bookkeeping environment (Source: LC 214, art. 378, II).

The costliest mistake

Treating the credit as an accounting balance. The ICMS recoverable balance in the ledger can be right and still not exist in the tax books. Accounting and tax books are two versions of the same fact, and only the second is audited by the tax authority.

Fixed assets

Fixed assets and CIAP

Fixed assets are where the credit is largest per transaction and where control is weakest, because the credit is taken over years. Each tax has its own installment rule.

1/48of the ICMS credit per month, from the month of receipt, times the share of taxed sales (Source: LC 87, art. 20, § 5)
48 monthsoption of 1/48 of the acquisition value for machinery and fixed asset equipment (Source: Law 10.833, art. 3, § 14). The 12-month option in Law 11.774 applies to new assets acquired from May 2008 to 02/08/2011; after that, the law sets a decreasing term and, from July 2012, immediate deduction (Source: Law 11.774, art. 1). Extending the 48-month option to PIS depends on a Federal Revenue rule.
Monthlythe PIS and COFINS credit on fixed assets generally follows the depreciation and amortization charges incurred in the month (Source: Law 10.637, art. 3, § 1, III)

CIAP: the control that proves each installment

  • What the CIAP is

The CIAP (Control of ICMS Credit on Fixed Assets) is the record that shows, month by month, which fraction of each asset's credit was taken. Asset-by-asset control, from registration to disposal, is covered in CIAP: asset-by-asset control.

Today it is delivered inside the EFD ICMS IPI, which replaces the paper ledger and document (Source: Ajuste SINIEF 02/09). The part of the file about fixed assets is described in the section on the CIAP of the page on ancillary obligations.

  • Why the fraction changes

The law says to multiply the total credit by one forty-eighth of the ratio of taxed sales to total sales in the period, and it treats sales abroad as taxed (Source: LC 87, art. 20, § 5, III).

That is why the credit on the same asset changes from one month to the next, and SAP must hold the correct ratio for the establishment at every close. The blog article on the CIAP of an idle factory shows how this ratio becomes the blind spot.

Five points to watch in SAP

  • Asset record. Each fixed asset needs the purchase document, the tax amount shown and the date it entered the establishment. Without the date, the first installment has no month (Source: LC 87, art. 20, § 5, I).
  • Monthly ratio. Taxed sales and total sales of the establishment in the period, with exports treated as taxed for this calculation (Source: LC 87, art. 20, § 5, II and III).
  • Disposal or sale of the asset. Future credit installments must stop or be corrected. The law also requires reversal of the credit on an asset that perishes, deteriorates or is diverted to a purpose unrelated to the business (Source: LC 87, art. 21).
  • PIS and COFINS on the asset. Check that the chosen method (depreciation, 1/48 or, in the cases Law 11.774 provides, 1/12) is the same in accounting and in the EFD-Contribuições, and that the asset is linked to revenue subject to the regime (Source: Law 10.637, art. 3) (Source: Law 11.774).
  • Sale of an asset before the end of the term. How the asset is used in production or in providing services weighs on the right to credit. The blog article on the PIS and COFINS credit on fixed assets covers this case.
PIS and COFINS

Base, input and the thesis on ICMS

PIS and COFINS credit is where the debate over what counts as an input is hottest. The law lists what gives the right (Source: Law 10.637, art. 3), and Law 10.833 repeats the structure for COFINS (Source: Law 10.833, art. 3).

  • Goods for resale
  • Inputs in production or in providing services
  • Rent of buildings, machinery and equipment
  • Energy
  • Financial leasing
  • Fixed assets
  • Buildings on third-party property
  • Other items of art. 3

Rules the ERP must carry

Supplier that is a legal entity based in Brazil. A purchase from an individual gives no credit, and the same goes for labor paid to an individual (Source: Law 10.637, art. 3, §§ 2 and 3).

Link to revenue. If only part of the revenue is non-cumulative, the credit is calculated only on costs, expenses and charges tied to that part, using direct allocation or proportional apportionment, kept for the whole calendar year (Source: Law 10.637, art. 3, §§ 7 to 9).

Purchases with no tax. Goods and services not subject to the contribution give no credit, nor do exempt items resold or used as input in a zero-rate product (Source: Law 10.637, art. 3, § 2, II). That is why the single-stage (monophasic) chain needs care; the blog has an article on the credit SAP calculates and the law denied.

Later use. A credit not used in one month can be used in the following months (Source: Law 10.637, art. 3, § 4).

Excluding ICMS from the base: what the Supreme Court decided and what SAP must show

  • 2017

    The thesis

On 15/03/2017, the Brazilian Supreme Court (STF) ruled in RE 574.706 (Topic 69 of general repercussion, rapporteur Justice Cármen Lúcia) that ICMS is not part of the PIS and COFINS calculation base (Source: STF Topic 69).

  • 2021

    The modulation

On 13/05/2021, when ruling on the Union's motions, the Court limited the effects: they apply after 15/03/2017 (date of the merits ruling), except for judicial and administrative actions filed up to and including 15/03/2017, and the ICMS to exclude is the amount shown on the invoice (Source: PGFN Opinion).

What this asks of SAP

For an SAP team, the practical consequence is not legal, it is about data.

If the company sells with ICMS shown, the ERP must deliver to the books the ICMS amount shown per invoice, separate from the transaction value, so the PIS and COFINS base is calculated without it.

If the base comes from a price condition that includes the tax, the difference shows up in the assessment, and the question is for how long, on which invoices and under what legal basis.

That last part is a legal decision. The data part belongs to the SAP team.

Two questions before any calculation

1. Does the assessment exclude the ICMS shown on all invoices, including adjustments and returns? 2. Does the EFD-Contribuições delivered over the years reflect this rule?

The two answers show whether there is an issue and how large it is; a claim, an offset or a lawsuit is a decision for the lawyer or the accountant.

Prior period

Credit from a prior period

An untimely credit is one the company had the right to take in a given month and did not. The cause is mundane: the invoice arrived after the close, the asset was not registered, the CFOP was wrong, the apportionment came out different. What decides whether it is still usable is not the reason, it is the deadline and the way it is booked.

TaxWhat the rule saysWhat depends on a complementary rule
ICMSThe right to use the credit ends five years after the document issue date, and the credit requires booking within the deadlines and conditions of the law (Source: LC 87, art. 23).Deadline and form for booking an untimely credit in each state. The complementary law defers to state legislation.
PIS and COFINSA credit not used in one month can be used in the following months (Source: Law 10.637, art. 3, § 4).The posting procedure, the adjustment of periods already delivered and any correction of the EFD-Contribuições follow Federal Revenue rules and the guidance of the generator program (Source: Federal Revenue, EFD-Contribuições).
IPIThe regulation allows credit on inputs and packaging used in a taxed product (Source: IPI Regulation, arts. 225 and 226).Booking outside the period and balance correction follow the IPI rules in force at the time.
CBS and IBSPIS and COFINS credits not taken until the contributions end remain usable, as long as they are recorded in the bookkeeping environment (Source: LC 214, art. 378).The refund and offsetting requirements, which the law says must be met at the date of the request.

The safe approach, in four steps

Step 01

Collect

Gather, with the tax document in hand, what was not taken.

Step 02

Separate

Tell what is still within the deadline from what has already passed it.

Step 03

Confirm

Validate with the legal team or the accountant how to post it and the risk of each line.

Step 04

Fix the cause

Adjust the setup in SAP: an untimely credit recovered without this happens again next month.

The blog article on the credit the law preserves and the SPED file that decides if it survives shows the same reasoning applied to the turn of the reform.

Using the credit

How the credit becomes an offset or cash

Having a booked credit is not the same as receiving it. The credit leaves the books by one of four paths, and the law picks the path by tax.

PathHow it worksWhen it appliesBasis
Deduction from the same tax's liabilityThe period's credit, plus the credit balance from earlier periods, reduces the tax due in the assessment. This is the normal path. For ICMS, obligations are settled by offsetting up to the credits booked in the period plus the prior credit balance.(Source: LC 87, art. 24)
Transfer of an ICMS credit balanceThe balance accumulated by exporting establishments can be assigned to another establishment of the company in the state or transferred to other taxpayers in the state, in proportion to export sales.Establishment with export sales and a persistent credit balance.(Source: LC 87, art. 25, § 1)
Offsetting against federal debtsA taxpayer with a credit that can be refunded or reimbursed may use it to offset its own debts for taxes administered by the Federal Revenue, by declaration. Offsetting extinguishes the debt, subject to later approval.Federal tax credit with a right to reimbursement, or an undue payment.(Source: Law 9.430, art. 74, main text and § 2) (Source: Federal Revenue, PER/DCOMP)
Cash refundPIS and COFINS: on exports, the credit not used by the end of each quarter can be requested in cash. IPI: the credit balance accumulated in the quarter, from inputs and packaging, can be used under arts. 73 and 74 of Law 9.430.Credit balance that deduction does not use up, in the cases the law provides.(Source: Law 10.637, art. 5, § 2, and Law 10.833, art. 6, § 2) (Source: Law 9.779, art. 11)
Step 01

Assess

Close the period with the credit checked, reversals done and the credit balance identified by establishment.

Step 02

Choose the path

Deduction, transfer, offsetting or a refund request, depending on the tax and the balance.

Step 03

Declare

For federal taxes, through PER/DCOMP, with the credit and the debts stated in the declaration.

Step 04

Follow up

Check the processing, answer any notice and keep the evidence until approval.

The Federal Revenue gathers in one portal the generator program (PGD PER/DCOMP), the manual, the processing lookup and the notice form (Source: Federal Revenue, PER/DCOMP). The deadline to approve a declared offset is five years from the date the declaration is filed (Source: Law 9.430, art. 74, § 5). This means the documents that support the credit must stay accessible, in SAP or elsewhere, for that long.

For ICMS-ST (tax substitution), reimbursement of tax withheld in the earlier transaction is up to the state. For interstate transactions, Convênio ICMS 142/18 leaves it to each state to accept it by a dedicated NF-e with prior authorization within 90 days, or to set another form (clause 15, main text, § 1 and § 5) (Source: Confaz, Convênio ICMS 142/18). The format of the request varies by state and changes over time. In our judgment, not measured, a request usually stalls at the required file; the two central risks are document data and inventory. The proof is three questions: do the inventory, the reimbursement file and the SPED Fiscal inventory blocks tell the same story? Does reprocessing give the same result? Who answers for each manual adjustment? We prove that data and inventory match at all three points. The right to the credit and the decision to claim it belong to your company.

The mechanics of ST are in ICMS-ST and DIFAL in SAP, the file in SPED Fiscal and the assessment in tax assessment in SAP.

Deadlines

Deadlines that decide everything

The deadlines below come from the cited rules. They help organize the conversation with the legal team; they are not for deciding alone.

Use of an ICMS credit5 yearsto use the ICMS credit, counted from the document issue date (Source: LC 87, art. 23)
Refund request5 yearsto claim a refund of an amount paid by mistake or in excess, counted from the extinction of the tax credit (Source: CTN, art. 168)
Offset approval5 yearsfor the Revenue to approve the declared offset, counted from the date the declaration is filed (Source: Law 9.430, art. 74, § 5)
Use of CBS credits5 yearsto use the CBS credits of arts. 379 to 381, counted from the last day of the assessment period in which the credit was taken (Source: LC 214, art. 383)
DeadlineWhat countsWatch out
Advance payment of a tax subject to later approvalFor art. 168, I, of the CTN, the tax credit is extinguished at the time of the advance payment (Source: LC 118, art. 3).The start of the refund deadline depends on this milestone. Art. 168 of the CTN was also amended in 2026; read the consolidated text on the Planalto site before counting.
Calendar quarterThe refund of export PIS and COFINS and the IPI credit balance are handled by quarter (Source: Law 10.637, art. 5, § 2, and Law 10.833, art. 6, § 2) (Source: Law 9.779, art. 11).Closing the quarter with the balance identified by establishment saves weeks later.
Review of a CBS and IBS refundUp to 30 days for taxpayers in compliance programs, up to 60 days for requests that meet art. 40 and up to 180 days in other cases; with no decision, the refund is paid in the following 15 days (Source: LC 214, art. 39, §§ 3 and 4).An audit of the request suspends the deadlines and can last up to 360 days (§§ 5 and 6 of the same article).
Lawsuit or administrative request already filedOn the thesis of ICMS in the PIS and COFINS base, the modulation preserved lawsuits and administrative requests filed up to and including 15/03/2017 (Source: PGFN Opinion). It is a milestone of the thesis, not a general deadline. Each company needs to know which group it is in.

Limitation periods are a legal matter

The deadlines above are rule text. How to apply them to your case, with the date of each payment, is legal advice. The SAP team's task is to give that advice the list of documents with date, amount and booking status, in the format it needs.

In SAP

The credit's path in SAP

The credit travels a path of six stations in SAP. Each station has a different owner in the company, and loss happens in the handoff from one to the next.

  1. 01

    Master data

Tax classification (NCM), origin, intended use of the material and supplier data. A wrong entry here contaminates everything else. See tax master data.

  2. 02

    Inbound document

The electronic purchase invoice enters SAP with its XML stored. The document is the proof of the credit; see electronic tax documents.

  3. 03

    Tax determination

The TAXBRA pricing procedure calculates the taxes on the purchase, including CBS and IBS (Source: SAP Help, TAXBRA procedure). The tax code in the setup defines whether the tax is recoverable or becomes cost; this is the station of the right.

  4. 04

    Accounting and tax posting

The recoverable tax amount goes to recoverable tax accounts, and the tax document records the credit by tax. This is where the gap between ledger and tax books is born.

  5. 05

    Booking

The files of the EFD ICMS IPI and for EFD-Contribuições carry the credit to the tax authority. The CIAP goes along, for fixed assets. See ancillary obligations and SPED.

  6. 06

    Verification

Periodic reconciliation between document, ledger and tax books. This is the station almost nobody has and the one that returns the most information, because it exposes the five before it.

Where SAP tends to lose credit

  • Tax code that treats the tax as cost. An inbound entry whose tax code does not mark ICMS, IPI, PIS or COFINS as recoverable becomes part of the material cost, and the credit stops existing in the ERP. The check compares the right under the law with what the setup does, line by line, in the full tax setup.
  • Document not linked to the asset. A machine purchase invoice that does not reach the fixed asset record with the date and the tax amount: the CIAP is born with no installment, and the PIS and COFINS credit cannot find the depreciation base.
  • Reversal the ERP does not see. Write-off for loss, theft, sale or change of destination happens in the warehouse or in assets and does not reach the assessment. The law requires a reversal in these cases (Source: LC 87, art. 21).
  • File generated outside SAP. A manual adjustment in a spreadsheet, at the file stage, creates a gap between what the ERP shows and what the Revenue receives. The column missing from these reconciliations is almost always the credit one.
  • Apportionment with no record. When only part of the revenue is non-cumulative, the apportionment method must be the same all year (Source: Law 10.637, art. 3, § 9). Without the record of the calculation, one month's credit cannot be reproduced the next month.
  • Correction with no trail. The EFD is corrected, SAP is not, and at the next extraction the gap returns. The adjustment must go back to the source.

The calculation and tax determination layer can stay in the native engine or in a dedicated product. The GUEPARDO Tax, a product of NTT DATA whose license DFSpro sells as an Authorized Channel, is a tax engine that calculates the tax and generates and validates the obligations on the same base, which shortens the distance between station 3 and station 5. Checking the credit holds whichever engine you use.

Step by step

Verification roadmap

This is the roadmap a team should follow to know, with proof, how much credit exists to take, to correct or to use. It does not depend on any tool and can be done by establishment.

01

Set the period and the taxes

Start with the last five years of ICMS and with the period the legal team indicates for PIS, COFINS and IPI. Record the establishment, the tax and the period of each analysis, because the deadlines above are counted by document.

02

Extract the inbound documents

Pull from SAP the inbound invoices with access key, tax amount, tax code and CFOP. Cross-check with the stored XML. An invoice in SAP with no XML, or an XML with no invoice in SAP, is the first exceptions list.

03

Check the right, transaction by transaction

For each group of invoices, compare the SAP treatment with the law: ICMS with a taxed sale, IPI on an input of a taxed product, PIS and COFINS with a legal-entity supplier and a link to revenue. Record the reason for each group that differs.

04

Check the calculation

Base, rate, CIAP ratio and apportionment method. On the sales side, check whether the PIS and COFINS base excludes the ICMS shown, on the invoices the thesis covers.

05

Reconcile with the books

Compare document credit, ledger credit and EFD credit, by period. The gap has three possible origins: SAP did not take it, SAP took it and the file did not carry it, or the file carried something different.

06

Classify each gap

Credit due and not taken, credit taken improperly (which requires a reversal), credit without enough proof and a presentation difference. Only the first class is a recovery candidate, and only after the legal team validates it.

07

Choose the path of use

Deduction in the assessment, transfer, offsetting by declaration or refund, with the formal decision of whoever answers for the company. Section 07 shows the options and their bases.

08

Fix the cause and set up the control

Adjust the setup, the master data or the process that created the gap and create a monthly reconciliation. Recovering without fixing the cause turns the project into a cleanup that repeats every year.

Readiness

Readiness checklist

Use the list to see where to start and what is still missing before talking about value.

  • There is one owner per tax (ICMS, IPI, PIS and COFINS) and one per establishment.
  • The list of establishments shows each one's assessment regime.
  • Inbound invoices have the XML stored and the access key linked to the SAP document.
  • Each tax code is compared with the right under the law, and the differences are recorded.
  • Fixed assets have an entry date, tax amount and a link to the purchase invoice.
  • The CIAP has the ratio of taxed sales calculated by establishment and by month.
  • The PIS and COFINS apportionment method is documented and is the same across the calendar year.
  • The PIS and COFINS base of sales excludes the ICMS shown, and the start date of this rule is recorded.
  • Reversals (loss, theft, write-off, change of destination) reach the assessment through a process, not by email.
  • The tax books are reconciled with the ledger and with the documents every month.
  • Manual adjustments in the EFD have a source, an owner and a return path to SAP.
  • Credit balances are identified by establishment and by quarter.
  • The documentation of offset and refund requests is kept, with the receipt and the processing lookup.
  • The legal team received the list of documents with date, amount and status, and gave feedback on deadline and route.
  • PIS and COFINS credits that cross the reform are recorded in the books (Source: LC 214, art. 378, II).
Mistakes

Mistakes that repeat in credit projects

Ten failures that show up often when the topic is handled as a one-off push and not as a control.

01

Treating the accounting balance as credit

The ICMS recoverable balance in the ledger proves nothing to the tax authority. Only the tax books and the document do. Always reconcile the three versions.

02

Waiting for the deadline to look

The deadline runs by document. A credit from five years ago has already lost part of its invoices. Start with the oldest period that still fits.

03

Fixing only the symptom

Recovering the month's credit and leaving the setup as it was guarantees the problem comes back. The cause sits in the tax code, the master data or the process.

04

Accepting a spreadsheet calculation with no record

A spreadsheet with the apportionment or the CIAP ratio and no source for the numbers cannot be reproduced in an audit. Keep the record and the date.

05

Forgetting the reversal

A credit taken and later undone by loss, exempt sale or change of destination must be reversed. Recovery without reversal creates a liability.

06

Mixing the thesis with the routine

The debate on excluding ICMS from the PIS and COFINS base is a legal decision. The routine of calculating the right base from now on is setup work. Keep the two apart.

07

Ignoring the monophasic chain and the zero rate

A purchase with no contribution gives no PIS and COFINS credit. See the list in art. 3 and the blog article on the monophasic chain.

08

Correcting the file without correcting the source

An EFD corrected on its own leaves SAP with the old data. At the next extraction the gap returns.

09

Leaving the PIS and COFINS credit out of the books

The law keeps the credit not taken at the turn of the reform, but requires it to be recorded in the bookkeeping environment. A credit that exists only in the tax team's memory does not cross over.

Requesting a refund without organized evidence

The request can be audited after payment, and a refund does not rule out a later audit of CBS and IBS (Source: LC 214, art. 39, § 8).

Tax reform

The bridge to the CBS and IBS

The tax reform creates the CBS and IBS credit and sets what happens to the PIS and COFINS credit at the turn. The reference text is Complementary Law 214/2025, and the overview of the change is on the page about tax reform, CBS and IBS.

TopicWhat LC 214 saysWhat SAP must ensure
When the CBS and IBS credit is bornA regular-regime taxpayer takes credit when the supplier's liability is extinguished by one of the methods in art. 27, and the credit is taken separately for each tax (Source: LC 214, art. 47).Record the extinction of the liability by document and keep two separate balances, with no cross-offsetting. The blog article on the credit stuck in accounts payable explores the risk.
What gives no creditImmune, exempt or zero-rate transactions, deferral or suspension do not let the buyer take credit (Source: LC 214, art. 49).Flag, for each purchase item, whether the transaction creates credit or not. For capital goods, see the article on the data the tax team does not keep.
Balance to recoverThe taxpayer can request a full or partial refund; the remainder becomes credit for future offsetting (Source: LC 214, art. 39).Identify the balance by period and by establishment, as in today's PIS and COFINS.
PIS and COFINS credit at the turnCredits not taken or not used until the extinction remain valid, must be recorded in the bookkeeping environment and can offset CBS or be refunded or offset against federal taxes, under the requirements of the time (Source: LC 214, art. 378).Carry to the EFD-Contribuições every balance the company intends to use. See the article on the credit balance and the EFD-Contribuições.
Fixed asset credit in progressCredits taken through depreciation, amortization or monthly installment continue to be taken, as presumed CBS credits, as set by the original laws (Source: LC 214, art. 380).Keep each asset's schedule in the fixed asset record, without restarting the count.
Term of useThe right to use the credits of arts. 379 to 381 ends in 5 years, counted from the last day of the assessment period in which the credit was taken (Source: LC 214, art. 383).Expiry control by credit batch.

The bridge is simple to say and laborious to build. An old credit only reaches CBS if it is proven in the books; a new credit only arises if the electronic document is correct and the supplier's liability is extinguished. Whoever cleans up today's credit, with proof, is already organizing the base of tomorrow's credit.

Tax reform

Credit pipeline: when it arises under the five methods of extinction

The table above says when the credit arises. Here is the step before: how the extinction reaches the supplier's liability under each of the five methods in art. 27 of LC 214/2025. Pick the method and flip the switch to see what happens to the credit while the liability has not been extinguished.

The switch shows what changes in the credit when the liability has not yet been extinguished.

What applies to all five methods

The five methods as a list

    • I. Offsetting with credits. The taxpayer uses IBS or CBS credits it took itself, under arts. 47 to 56 (art. 27, I). Link: Applied to the liabilities not yet extinguished from the period's transactions, in chronological order of the tax document, under the regulation's criteria (art. 27, sole paragraph, I).
    • II. Payment by the taxpayer. The taxpayer pays the balance due by the due date (art. 27, II, with art. 29). Link: Applied to the period's liabilities not yet extinguished, in chronological order of the tax document, under the regulation (art. 27, sole paragraph, I).
    • III. Collection at financial settlement. The tax is collected at the financial settlement of the transaction itself, known as split payment (art. 27, III, with arts. 31 to 35). Link: Linked to the respective transaction (art. 27, sole paragraph, II).
    • IV. Collection by the buyer. The regular-regime buyer collects the IBS and CBS of the transaction when payment to the supplier uses an instrument that does not allow the split payment segregation (art. 27, IV, with art. 36). Link: Linked to the respective transaction (art. 27, sole paragraph, II).
    • V. Payment by whoever the law holds liable. Paid by whoever the Complementary Law makes responsible (art. 27, V). Link: Linked to the specific transaction it refers to; if it does not refer to a specific transaction, it is applied as in methods I and II, in chronological order (art. 27, sole paragraph, III).

    Applies to all

    • The IBS credit and the CBS credit are taken separately: an IBS credit cannot be offset against CBS due, nor the reverse (art. 47, § 1, I).
    • Taking the credit depends on proving the transaction with a valid electronic tax document (art. 47, § 1, II).
    • The credit amount is the liability shown on the purchase tax document and extinguished by any method in art. 27 (art. 47, § 2, I), or the presumed credit, when the law provides one (art. 47, § 2, II).
    • Personal use or consumption is excluded (art. 47, main text, with art. 57). Extinction is waived in two cases: fuels under the specific regime (art. 47, § 4) and the case in art. 48, which only applies if neither split payment nor collection by the buyer has been implemented and requires the correct amount shown on the tax document.

Official source: consolidated text of Complementary Law 214/2025, with the wording from Complementary Law 227/2026 (arts. 27, 29, 36, 47 and 48). Out of scope are the apportionment criteria the regulation defines and the start date of each method. The decision on how to apply the rule belongs to the company.

The inventory of 01/01/2027, month by month

Art. 381 of LC 214/2025 gives the regular-regime CBS taxpayer a presumed credit on the stock of physical goods it holds on 01/01/2027. The window to take it closes on 30/06/2027, and use is in 12 monthly installments, starting in the period after the credit is taken. Pick the month you take the credit and see where each installment falls.

Illustrative value. The credit is 9.25% of the inventory value for goods acquired in Brazil.

01/01/2027:inventory that counts for the credit. Then tap a month in the first band to choose when the credit is taken.

Window to take the credit (Jan to Jun 2027)Chosen month to take the credit1/12 installment to offset against CBSOut of time

    The rule as a list

    • Credit amount. Goods acquired in Brazil: 9.25% of the inventory value (art. 381, § 3, I). Example with BRL 1,000,000.00: credit of BRL 92,500.00, installment of BRL 7,708.33.
    • Taking the credit. The window closes on 30/06/2027: by then the credit must be calculated and taken (§ 4, I).
    • Use. In 12 equal, successive monthly installments, starting in the period after the credit is taken (§ 4, II). If the credit is taken in March 2027, the first installment falls in April 2027 and the last in March 2028.
    • Destination. Only offsetting against CBS. It does not offset other taxes and there is no refund (§ 4, III).
    • Lifetime of the right. It ends after 5 years, counted from the last day of the assessment period in which the credit was taken (art. 383).

What is included, according to the main text

    • Item I. If on 31/12/2026 the company was under the cumulative PIS/Pasep and Cofins regime, goods in stock on which no credit was calculated because of that regime.
    • Item II. Goods in stock subject, at purchase, to tax substitution or to the monophasic charge under the provisions the article lists.
    • Item III. The part of the inventory value subject to the partial credit bar of §§ 7 to 9 of art. 3 of Laws 10.637/2002 and 10.833/2003.

What is left out, according to § 1

    • Goods that are not new, not bought from a legal entity in Brazil, or not imported for resale or for use in production or in services to third parties.
    • Products bought at zero rate, exempt, suspended or with no PIS/Pasep and Cofins charge.
    • Goods for personal use and consumption, under art. 57.
    • Fixed assets and real estate.

Illustrative example, not an assessment value. It assumes monthly CBS assessment. Imported goods follow another calculation (the credit is the PIS/Pasep on imports and Cofins on imports actually paid, art. 381, § 3, II) and are not modeled. The way to verify inventory will be set by an act of the Executive Branch (§ 2); that act is out of scope. Deciding whether and how to take the credit, and proving the inventory item by item, belongs to the company.

    Frequently asked questions

Frequently asked questions about tax credit recovery in SAP

01What is a tax credit and why does it need to be recovered?+

A tax credit is the tax paid on a purchase that the company can deduct from the tax due on a sale. It is not always taken: a wrong document, a setup that treats the tax as cost or incomplete booking make the credit fail to appear. To recover means to identify, with proof, the credit the law allows that was left out.

02What gives the right to an ICMS credit?+

The receipt of goods, actual or symbolic, including for use or consumption and fixed assets, and the receipt of interstate and intermunicipal transport and communication services. Exempt or non-taxed inputs give no credit, nor do goods unrelated to the business. Credit on goods for use or consumption is only allowed from 01/01/2033 (LC 87, arts. 20 and 33).

03How does the ICMS credit on fixed assets work?+

The credit is taken at one forty-eighth per month, with the first fraction in the month of receipt, multiplied by the share of taxed sales over total sales in the period. The control is the CIAP, delivered in the EFD ICMS IPI (LC 87, art. 20, § 5).

04What does the law require in documents and booking for an ICMS credit?+

Valid documentation and, where applicable, booking within the deadlines and conditions of the law. The right to use the credit ends five years after the document issue date (LC 87, art. 23).

05What did the Supreme Court decide on ICMS in the PIS and COFINS base?+

In RE 574.706 (Topic 69), on 15/03/2017, the Court held that ICMS is not part of the PIS and COFINS calculation base. On 13/05/2021, ruling on the motions, it limited the effects to after 15/03/2017, preserving lawsuits and administrative proceedings filed up to and including 15/03/2017, and set that the ICMS excluded is the amount shown on the invoice.

06Does SAP exclude ICMS from the base automatically?+

It depends on the setup and on the version of the tax solution. The right question is whether the company's assessment delivers the ICMS shown per invoice, separately, and whether the EFD-Contribuições reflects the rule in the periods in which it applies. The check is done in the setup and in the file.

07What counts as a PIS and COFINS credit?+

The law lists goods for resale, inputs, rent, energy, financial leasing, fixed asset machinery and equipment, buildings on third-party property and other items of art. 3. The credit requires a supplier that is a legal entity based in Brazil and a link to revenue under the non-cumulative regime (Law 10.637, art. 3).

08Can I use today a credit I did not take in the right month?+

For PIS and COFINS, the law says a credit not used in one month can be used in the following months. For ICMS, the right lasts five years from the document issue date, and the way to book it comes from state legislation. The way to post it and the risk are assessed by the legal team or the accountant.

09What is the difference between offsetting and a refund?+

Offsetting uses the credit to settle the company's own federal tax debt, by declaration (PER/DCOMP, Law 9.430, art. 74). A refund is a cash payment of the credit balance in the cases provided, such as the IPI quarterly balance and the export PIS and COFINS credit not used in the quarter.

10How long does the Revenue have to approve an offset?+

Five years, counted from the date the offset declaration is filed, under § 5 of art. 74 of Law 9.430. Offsetting extinguishes the debt subject to later approval, which is why the documents must be kept.

11What happens to the PIS and COFINS credit when the contributions end?+

LC 214, art. 378, says that a credit not taken or not used remains valid and usable, must be recorded in the bookkeeping environment, can offset CBS and can be refunded or offset against federal taxes if it meets the requirements. Art. 383 sets 5 years to use the credits of arts. 379 to 381.

12How is the CBS and IBS credit born?+

When the supplier's liability is extinguished by one of the methods in art. 27 of LC 214, and the credit is taken separately for each tax, with a valid electronic tax document (art. 47). An immune, exempt or zero-rate transaction gives the buyer no credit (art. 49).

13Does DFSpro do the recovery, the request or the legal opinion?+

In an SAP project, DFSpro handles the tax layer: it maps where the credit is born and lost, fixes setup and master data, does ABAP development and tax customization when needed and organizes the evidence. Legal advice and the decision to claim, offset or dispute a credit belong to the company's legal team and accountant.

14How much can my company recover?+

No generic text answers that. The value depends on checking, document by document, what the law allows, what was already taken and what is within the deadline. The check may point to a relevant amount, a small one or none, and only after it is there a number.

    15Where do I start?+

With the list of establishments and taxes, the five-year period and the cross-check between inbound invoices, ledger and tax books for one establishment. The readiness assessment and the contact conversation are the two routes to that first step.

    Next steps

Start with the reconciliation of one establishment

If you already have the list of establishments and want to know where credit is lost in SAP, the readiness assessment organizes the starting point. To ask about the fit with your project, write through the contact page.
